본 논문은 고독사를 오늘날 극도로 개인화된 사회적 현상의 하나로 이해하여, 1인 가구를 필두로 고독하고자 하는 개인의 자유를 존중하는 것이 옳은지, 아니면 고독사를 사회적인 문제로 이해하고, 생명권을 보호하고 인간의 존엄을 위하여 많은 관심과 관리를 통해 적극적으로 개입해야 하는 것인지에 관하여 법윤리적으로 검토하였다. 검토 결과는 다음과 같다. 고독사를 법윤리적 차원에서 바라볼 때, 개인의 자유로서 고독을 선택할 수 있음을 인정하며, 오늘날 점점 더 개인화되고 있는 사회적 현상으로서도 필연적으로 받아들이고 수용해야 할 부분이라고 본다. 하지만 고독을 자유라고 인정한다고 해서, 고독사가 야기될 정도로 방치하는 것을 인정하지는 않는다. 즉 개인의 문제로 축소시키고 방치하는 것이 아니라, 국가 및 사회적 문제로 인식하고, 적극적으로 개입하여 우리 헌법이 보장하는 기본권 중에서도 최고의 권리라고 할 수 있는 생명권을 보호하고, 나아가 인간의 존엄성도 지켜낼 수 있도록 나서서 대비해야 할 것이다. 이는 단순히 윤리적ㆍ도덕적인 판단이 아닌, 법윤리적 차원의 인식이라는 점에서 의미가 있는 주장이라고 할 것이다. The purpose of this study is to make ethical and legal review on whether we understand the lonely death as extremely individualized and social phenomenon and respect for the freedom of the individual or whether we should positively intervene with interest and management to protect the right of life for the dignity of man, by understanding it as social problem. The findings are as follows. From the legal and ethical perspectives, we admit that the lonely death can be selected as the freedom of the individual and inevitably accept it as an gradually individualized social phenomenon. However, we cannot admit to neglect the lonely death because the loneliness is the freedom of the individual. In other words, it should not be minimized and neglected but should be recognized as national and social problem to intervene positively to protect the right of life, the extreme right of the basic human right and keep the dignity of man further. It is meaningful that this is not by ethical and moral judgement but a recognition from legal and ethical perspective.
