      • 온라인서비스제공자에 대한 정보제공청구에 관한 비교법적 연구

        오늘날 인터넷의 발달에 의해 다양한 정보를 제공해주기도 하지만, 인터넷사이버공간에서 디지털저작물 침해, 명예훼손성 게시물 등 불법정보들로 넘쳐나고 있으며, 그 중 타인의 저작물을 불법복제, 유통함으로써 저작권자의 권리를 침해하고 있다. 이러한 저작권침해는 대부분 온라인서비스를 통하여 이루어지고 있다. 저작권자가 인터넷 사이버공간에서 저작권 침해자를 특정 하는데 어려움이 있으므로 온라인서비스제공자를 공동불법행위자로서 특정하고 침해입증과 손해배상 산정을 목적으로 민사소송법상 문서제출명령제도를 통하여 온라인서비스제공자에게 자료제출요청을 하였다. 하지만 온라인서비스제공자가 공동불법행위자가 아닐 경우에는 동법을 적용함에 있어 어려움이 있었다. 미국, EU, 일본 등의 입법례 및 국제조약 등은 저작권자의 요청이 있을 경우 온라인서비스제공자는 침해자에 대한 자료를 제공할 수 있도록 규정하고 있으며 우리나라의 경우 「한-미 FTA협정」을 통하여 “미국 디지털 밀레니엄 저작권법(Digital Millenium Copyright Act)”의 정보제출명령(subpoena) 규정과 유사한 정보제공청구제도를 도입하였으며 2011년 12월 2일 저작권법 개정을 통하여 저작권법 제103조의 3(복제․전송자에 관한 정보 제공의 청구)을 신설하였다. 위 제도는 인터넷 사이버공간에서 저작권자가 자신의 저작물이 불법 유통된 것을 확인한 경우 저작권자는 해당 온라인서비스제공자(Online Service Provider)에 대하여 침해자에 관한 정보제공 요청할 수 있는 권리를 부여함으로서 저작권자의 권리를 보호하기 위한 일련의 절차라고 볼 수 있다. 그러나 저작권자가 온라인서비스제공자에 대하여 침해자에 관한 정보제공청구에 따른 절차의 모호함, 결정주체의 적합성 여부, 제공정보 범위의 불명확, 통신비밀보호법 등 관련 법률 위반에 따른 온라인서비스제공자의 책임 여부 등이 불분명하다. 또한 최근 인터넷 상에서 주민번호 수집․이용을 금지하고 있어 저작권자가 온라인서비스제공자를 통한 침해자 특정의 어려움이 예상된다. 이에 따라 본 논문에서는 온라인서비스제공자 유형에 따른 책임과 해외 주요국가(미국, EU, 일본)의 ‘정보제공명령’제도에 대하여 비교 고찰한 후, 우리나라의 민사소송법의 ‘문서제출명령’제도와 같이 침해에 대한 입증 및 손해배상 산정을 위하여 규정되어 있는 ‘정보제공’제도 등에 대하여 살펴보고 저작권법에 규정되어 있는 ‘정보제공청구’제도의 문제점 및 개선방안에 대하여 연구하고자 한다.

      • 수출입물류정보시스템의 품질이 물류성과에 미치는 영향에 관한 연구 : 국제물류주선업체를 중심으로

        무역의 한 부분으로써의 수출입물류와 관련한 정보시스템의 역할과 기능을 고찰해보고, 수출입물류분야에서 중요한 역할을 수행하는 국제물류주선업체를 중심으로 물류정보시스템을 사용하는 기업의 내·외부환경과 물류정보시스템의 서비스적 요인이 물류정보시스템에 대한 서비스품질의 평가에 영향을 미치며, 이러한 차등 화된 서비스품질의 평가로 인하여 물류기업의 성과에 차이가 있음을 실증적으로 분석하고, 물류정보시스템의 발전방향에 대해 고찰해보고자 하는 것이 본 연구의 목적이다. 본 연구는 물류정보화 부문 각 종 저널 및 각 대학의 석, 박사학위 논문 등의 자료와 인터넷 및 각종 정부 정책발표자료등을 중심으로 하는 문헌적 조사를 바탕으로 이론적 배경을 고찰하고, 국내의 국제물류주선업체를 대상으로 설문조사를 통한 실증적 연구방법을 취하였다. 실증적인 분석을 위해 수집된 설문지를 근거로 SPSS를 활용한 통계적 분석방법인 빈도분석, 신뢰도검증, 상관분석, 회귀분석 등을 사용하여 검증하였다. 본 연구의 결과를 요약하면, 국제물류주선업체의 기업 내·외부요인은 물류정보시스템의 서비스품질 수준에 정(+)의 영향을 미치고, 이러한 물류정보시스템의 서비스품질은 물류성과의 운영적성과 및 전략적성과에 정(+)의 영향을 미친다고 할 수 있다. 이러한 연구결과에도 불구하고, 본 연구에서는 물류정보시스템의 서비스품질의 5개차원에 대한 설문항목을 1~2개로 제한하여 타당성확보에 한계가 있었으며, 각 요인별로 구조방정식 모형을 활용한 경로분석이 이루어지지 않아 각 요인들 간의 정확한 인과관계규명에 있어 한계가 있었다. Recently many firms have embraced logistics information system in their logistics operations in order to save costs and satisfy the customers. The purpose of this study was to examine empirically the effect of companies' internal factors, environmental variables and service characteristics of logistics information system on the service quality evaluation, and its effect on logistics performance. In addition, this study was performed to provide guidelines for logistics companies to adopt future-oriented logistics information system in order to gain sustainable logistics capability. The survey was conducted for the registered freight forwarder companies on KIFFA(Korea International Freight Forwarders Association) to test model and 122 samples were collected. After collecting the data, the Cronbach' Alpha Coefficients, factor analysis, correlation analysis, and regression analysis were used for assessing reliability and analyzing the model. The result showed that companies' internal factors, environmental variables and service characteristics of the logistics information system had significant impacts on the service quality, and the service quality had also significant impacts on the logistics operational and strategic performance such as the reduction of the logistic costs and the improvement of customer satisfaction etc. In the future study, it is suggested that the structural equation modelling analysis could be considered as a proper measuring method. Also, in measuring the logistics information system service quality, more questionnaire for each item of SERVQUAL instrument is proposed and can be used to diagnose the service quality of the import and export logistics information system.

      • 무선호출기 디자인 개발에 관한 연구

        The human beings seeking for the convenience and the individualization of communication have been yearning for communicating with one another beyond time and place. Due to these desires, the pager service has rapidly been developed into a service which makes it possible to exchange much information at high speed. The universal mobile phone services are the cellular phone and the pager, among which the latter is the most universal worldwide. The pager at the early stage had the simple function to offer the caller's numbers. And then the pager came to offer the additional functions such as the text service and information service and the various styles of the pager. Since the introduction of the pager service in December, 1982, the subscribers has rapidly changed from some people who belonged to the privileged class to businessmen and to the consuming public including the new generation. So, the pager, more than anything else, became the essential communication method in our daily life. The number of the pager subscribers in 1994 exceeded 5 million people and, at present, exceeded 12 million people. That is, it turns out that at least one of the four people possesses one pager. The rapid growth in the pager service resulted from the fact that its charge was reasonable and that the young people tried to possess it as the necessaries of life and it also provided a variety of services with the recent technical development. In order to secure a great number of subscribers, there is a hot competition among the pager companies. To gain the superiority over the other pager companies, it is needed to offer the diversified services, the stylish designs of the beeper, to introduce CAID system which is helpful to cope with the consumers' life cycle. The introduction of CAID system removes a barrier between the processes of the business and shortens the development period. According as the consumers' demands are diversified and individualized, the life cycle of the products (i.e. the pager) can be shortened and the styling field can be intensified. In this thesis, I researched the most effective method of the design development in order to strengthen the competitiveness on the pager markets by presenting the new design patterns and functions and introducing CAID system to cope with the consumers' life cycle.

      • 한·일 FTA의 경제적 효과와 정책적 접근에 대한 연구

        자유무역협정(FTA)이란 정부간 대화채널을 통해 양국 혹은 다수국의 시장 개방과 제도, 정책의 조율과 협력을 추구하는 것을 근간으로 한다. 본 논문에서는 한·일간 자유무역협정(FTA) 체결에 따른 양국의 경제관계 및 구조, 주요 산업별 경제적 효과 그리고 향후 한·일간 자유무역협정 체결 후 동아시아의 경제협력과 과제를 연구하였다. 특히, 한·일 FTA의 체결시 우리의 대일 무역적자를 완화시키기 위한 양국간의 민감한 품목들의 시장접근방법과 일본의 비관세 장벽 극복을 연구 하였다. 지금 세계 경제는 지역주의를 통한 경제통합을 도모하는 시대이다. 외부의 환경변화에 능동적으로 대처하기 위해서는 지역무역협정 체결을 통해 보다 친숙한 국가 관계를 구축하고 새로운 통상문제에도 신속하게 대응하기 위해서도 이해관계가 유사한 국가끼리의 FTA 체결을 적극 고려해야 할 것이다. 따라서 우리나라는 한·일 FTA를 경제적인 측면뿐만이 아니라 향후 동아시아 경제통합을 위한 미래 전략적인 측면에서 추진할 필요성을 인식해야 한다고 본다. 세계의 제조공장이 되어버린 중국의 초고속 성장을 견제하는 차원에서 중국시장에 효과적으로 진출하고 또 중국과 경제협력을 강화하기 위해서 한·일간의 FTA가 향후 동아시아 FTA의 초석이 되어 우리나라가 미래의 경제적 중심축이 될 동아시아에서 중심적 역할을 했으면 하는 바램 이다. Free Trade Agreement" (FTA) is designed to pursue marketing opening, liberalization, coordination and cooperation between or among nations through an inter-governmental dialogue channel. The purpose of this study was to review the effects of Korea-Japan FTA on both nations' economic relationship and structures, major industries and East Asian economic cooperation in the future. In particular, this study was focused on how to help Korean companies' advance into Japanese markets and thereby, reduce the trade deficits between two nations and surmount the non-tariff barriers of Japan. Now, the world economy is being integrated by region. In order to respond actively to external environmental changes, it may be desirable for Korea to sign FTAs with major trading partners and therewith, establish a friendly relationship with them. Furthermore, in order to respond timely to new possible trade disputes, the Korean government is requested to consider about the possibility of singing FTAs with the nations with similar interests. In this regard, it is deemed necessary to review Korea-Japan FTA in terms of not only its economic aspects but also some futuristic strategic aspects for an economic union in the East Asian region. On the other hand, in order to check China's speedy growth attributable to its strategic location as world plant bases, and help our companies advance into Chinese markets effectively and strengthen the economic relationship with China, Korea needs to take advantage of Korea-Japan FTA to establish the Korean peninsula as future economic axis to play a leading role in the East Asian region.

      • 멀티미디어 디자인에서 정보시각화 방안에 관한 연구 : 웹 북마크 시각화 중심으로

        The early information expression was made by visualizing information with simple diagrams such as form, color and letter, but such an information expression in the age of digital has been varied and ability to communicate information has been developed not to be compared to the past one owing to rapid increase of information use. In particular, how to express information has been complicated with technical development of multimedia and it has been faced with difficulties in utilizing limited space due to limitation of canvas to express information compared to the amount of information. Various information visualization techniques to solve these problems have been proposed. Information visualization methods are to cope with rapidly increasing information and to make users understand complex and more information more easily. Information visualization in multimedia design is a visualization method to make users understand a large amount of information more easily and shows information necessary for users in limited screen space visually. In addition, it can refer to situation of a large capacity according to the stream of time, visualize a lot of hierarchy structures more easily and retrieve detailed information effectively. This study is to discover features and problems of visualization through analysis of information visualization cases in order to present how to retrieve a large amount of information effectively in information visualization of multimedia design area, arrange visualization embodiment factors through cases and propose effective methods for web bookmark visualization based on it. First, it analyzes features and problems of each visualization through visualization cases by information structure types in multimedia design like linear structure, hierarchy structure, network structure and vector scatter structure and then systematizes expression methods of information visualization based on these. Second, it arranges embodiment factors including binding, layout, clustering, overview, details-on-demand and filtering for visualization based on case studies of information visualization and provides basic data necessary for building information visualization in multimedia design. Third, it examines bookmark demands by users, applies characteristics and embodiment factors of information visualization obtained from case studies to this case and presents and embodies effective guideline of web bookmark visualization. Fourth, it conducts and verifies use convenience evaluation of web bookmark information retrieval visualization suggested. This paper suggests web bookmark visualization as a part of information visualization methods in multimedia design. Visualization of this research is presented with limited simulation embodiment, but it is considered that it will be very helpful in designing more effective web bookmark based on guideline of web bookmark visualization and in developing a new visualization interface development through feature analysis and expression methods of information visualization suggested in this research. Further expression of information visualization will be applied to all areas related to interface as well as information visualization in multimedia design with utilization of multi-dimensional space, combination with virtual reality and a new visualization method and be able to get more information efficiently.

      • Micro/macroscale simulations of planar intermediate-temperature solid oxide fuel cells operated with hydrogen and methane fuels

        The intermediate temperature solid oxide fuel cells (IT-SOFCs) are promising SOFC technologies that can solve many problems of high temperature SOFCs (HT-SOFCs), such as stringent restriction on material selection, accelerated degradation of electrode microstructure, limitation in thermal cycling, requirement for longer startup times, etc. Most of these constraints and limitations are originated from the operating temperature of HT-SOFCs around 1000C. Since IT-SOFCs are operated at relatively lower temperatures ranging from 600~800C, less expensive materials can be used with better long-term stabilities. In addition, the advantages of the SOFC technologies are largely retained, such as the use of non-precious metal catalyst, the direct internal reforming of hydrocarbon fuels, the production of quality waste heat, etc. Therefore, this dissertation presents the development of comprehensive three-dimensional micro/macroscale models for simulating, designing, and optimizing planar, anode-supported IT-SOFCs operated with hydrogen and methane fuels. The micro/macroscale models are constructed with many constitutive models, including the models for electrode microstructure characterization based on random binary packing theories, the models for electrode processes with detailed consideration on the electrochemical reactions at TPBs, the models for heat and mass transport in three-dimensional interconnect plate/gas channel geometries with fully-developed laminar flow assumption, and the models for direct internal reforming in the anode consisting of the steam reforming, water-gas shift reaction, and reverse methanation reactions. These simulations are performed with the properties of standard materials for IT-SOFCs, such as nickel, YSZ, LSM, and stainless steel. In addition, accurate thermodynamic properties are used for air (O2 and N2) and fuels (H2, H2O, CH4, CO, and CO2). The three-dimensional micro/macroscale model is utilized to investigate the performance and operating characteristics of planar, anode-supported IT-SOFCs with co- and counter-flow configurations, when they are fueled with wet hydrogen or partially reformed methane fuel. The currentvoltage performance curves are presented along with the contribution of activation, concentration, ohmic and contact overpotentials to total potential loss. In addition, the spatial distribution of temperature, current density, and concentrations is also investigated in detail. The simulation results indicate that hydrogen-fueled IT-SOFCs with the counter-flow configuration result in higher cell efficiencies than the co-flow configuration. However, the co-flow configuration is found to have more uniform distribution of temperature and current density compared with the counter-flow configuration. Thus, the co-flow configuration is concluded to be more advantageous for long-term stability of cell performance as well as mechanical durability of IT-SOFCs. Extensive parametric study is also performed to clarify the effects of operational, microstructural, and dimensional parameters. The simulation results also point out that the counter-flow configuration leads to higher efficiencies and more uniform distribution of temperature for methane-fueled IT-SOFCs. This is identified as caused by the endothermic steam methane reforming reactions. The results presented in this dissertation clearly demonstrate the capabilities of the present three-dimensional micro/macroscale models as an accurate and efficient design tool for optimizing the operating conditions, electrode microstructures, and cell geometries of planar, anode-supported IT-SOFCs as well as for quantitatively investigating the detailed chemical, electrochemical, and transport processes. 중온형 고체 산화물 연료전지는 고온 작동 조건에 의한 재료선택의 제한, 미세전극의 가속 열화, 열 사이클의 한계, 긴 작동 시간의 요구 등과 같은 문제점들을 해결 할 수 있는 기술로 주목 받고 있다. 이러한 제약 및 제한의 대부분은 1000도 근처의 작동 온도 조건의 고온형 고체 산화물 연료전지로부터 기인한다. 중온형 고체 산화물 연료전지는 상대적으로 낮은 600~800도의 작동 온도 범위를 가지므로, 보다 저렴한 재료 구성을 바탕으로 연료전지의 장기간 안정성을 확보할 수 있다. 게다가, 고체산화물 연료전지는 비백금 촉매의 사용, 탄화수소 연료의 직접 내부 개질, 그리고 양질의 폐열 생산 등과 같은 장점을 보유하고 있다. 본 논문은 수소 및 메탄 연료로 운전되는 음극 지지 중온 평판형 고체 산화물 연료전지의 설계, 평가 그리고 최적화를 위한 포괄적인 3차원 마이크로/매크로 모델 개발을 제시한다. 마이크로/매크로 모델은 랜덤 바이너리 팩킹 기반의 전극 미세구조 특성에 대한 모델, 전극 내 삼상계면에서의 전기 화학 반응 과정을 위한 모델, 인터커넥터를 포함한 3차원 기체 유로 내 완전 발달 유동 가정을 기반으로 한 열 및 물질 전달 모델, 그리고 증기 개질 반응, 수성-가스 전환 반응 및 역 메탄 반응으로 이루어진 음극 내의 직접 내부 개질을 위한 모델 등 다수의 구성 모델로 이루어져 있다. 개발된 3차원 마이크로/매크로 모델을 기반으로 니켈, YSZ, LSM 그리고 스테인리스 스틸과 같은 중온형 고체 산화물 연료전지의 표준 재료 물성치와 공기 (O2 and N2) 및 연료 (H2, H2O, CH4, CO, and CO2)의 정확한 열역학적 물성치를 이용하여 시뮬레이션을 수행하였다. 3차원 마이크로/매크로 모델은 병류 및 향류와 같은 유로 내 유동 조건과 수소 혹은 메탄을 연료로 운전되는 음극 지지 중온 평판형 고체 산화물 연료전지의 성능 및 작동조건의 특성을 평가하기 위해 이용되었다. 전류-전압 성능 곡선 안에 전체 전압 손실에 영향을 미치는 활성화 과전압, 농도 과전압, 저항 및 접촉 과전압을 세분화 하여 제시하였다. 또한, 온도, 전류 밀도, 그리고 농도에 대한 3차원 분포를 자세히 살펴보았다. 해석 결과는 병류 유동 조건 보다 향류 유동 조건의 수소 연료로 운전되는 중온형 연료전지의 효율이 높게 나타났다. 그리나 향류 유동 조건 보다 병류 유동 조건일 경우 온도와 전류 밀도에서 고른 분포를 나타내었다. 따라서 병류 유동 조건은 중온형 고체 산화물 연료전지의 장기간 전지 성능의 안정성뿐만 아니라 기계적 내구성 면에서 더 유리한 것으로 결론 내릴 수 있다. 또한, 작동 조건, 전극의 미세 구조 그리고 전지 형상의 매개변수들에 대한 영향을 명확히 파악하기 위하여 광범위한 매개 변수 연구를 수행하였다. 메탄을 연료로 사용하는 고체 산화물 연료전지 해석 결과에서는 향류 유동 조건이 병류 유동 조건에 비해 높은 효율과 균일한 온도 분포를 나타내는 것을 확인하였다. 이러한 결과는 흡열성 증기 개질 반응에 의한 영향 때문이다. 개발된 3차원 마이크로/매크로 모델를 통해 제시한 결과들로부터 음극 지지 중온 평판형 고체 산화물 연료전지의 작동 조건, 전극의 미세 구조 조건 그리고 전지 형상 조건의 최적 설계 도출뿐만 아니라 화학적, 전기화학적, 그리고 열 및 물질 전달 과정에 대한 정량적 평가를 위해 정확하고 효율적인 설계 도구란 것을 명확히 검증하였다.
