This study investigates the practical issues of ‘Act on Special Cases Concerning The Punishment, etc. of Child Abuse Crimes’ from the point of view of protection and support of child victims. Notwithstanding the fact that all children should be brought up with secured rights and safety in a healthy manner, the incidents of child abuse are steadily increased. Specifically, after the enactment of this act of child abuse in 2014, the incident cases in nursery and kindergartens have been more increased. Day-care teachers and staffs, as the next to parents, occupy the largest portion of child abuser. With a consideration of the fact that 74.8% of 5 years old and younger children attend nursery and kindergarten, it is a serious problem. This study investigated the difference between the regulation of child abuse special act and the real situation when the increasing number of nursery- kindergarten teachers and staffs are considered as a child abuser. Then, alternatives to the problems are proposed.
The problems are as follows; i) lack of sensitivity and social agreement on child abuse, ii) lack of consideration on various types of child abusers, iii) existing legal limit due to the scope of punishment regulations and differences in determination, iv) negative role of child protection institution, v) insufficient measures for protecting abused child.
The alternatives to these problems are as follows; First, an improvement of punishment: it is to reorder various related laws and preparing punishment protocol for different types of abusers. Second, an improvement of processing procedure: it is to unify report and investigation protocol, to establish one-stop support system and enhance authority of Child Protection Institution, and to strengthen expertise of case processing through professional personnel training. In order to acknowledge that child abuse is a crime, regular education as well as limiting opportunities of working at related institutions for those abusing assaults, and abuse-related monitoring and screening – such preventive level regulations should be also expanded. Third, an improvement of protecting abused child: it is required to establish a system for effective protection of the victims and prevention of the recurrence of the abusers, with implementation of strengthening the obligation to report child abuse incident and treatment for victims. Particularly, a detailed guide line or manual should be prepared with consideration of the cases of child abusers other than parents.
This study is significant in that it approaches the viewpoint of victims considering the incidents of abusers including others, specifically, day-care teachers and staffs under special act of child abuse, while most of previous studies on child abuse focuses on the parents as child abusers.
It is necessary to view the problems of child abuses so that children can grow healthy with recognition them as a whole human being and social interests about child protection. Based on high leveled social consensus, it looks forward to improving social conception, awareness, laws, and regulation for the prevention of child abuse and the appropriate procedure of abusive cases.
