미국 반덤핑법의 국내산업 피해판정기준 운용에 관한 고찰 = A Study on the Interpretation of the criteria of Domestic Industry Injuries in U.S. Anti-dumping Law

Dumping is traditionally defined as price discrimination between national markets. Under the current U.S. Antidumping Law if Department of Commerce determines dumping, and International Trade Commission(ITC) determines injury by reason of imports of dumping, then there shall be imposition of an antidumping duty upon such merchandise. There are three possible standards for legally actionable injuries to the domestic industry: (1) material injury to an established domestic industry, (2) threat of material injury to an established domestic industry, and (3) material retardation of the establishment of the domestic industry. The injury determination is a function of myriad factors relating to the relative economic condition of the concerned U.S. industry. But, no single factor is given decisive effect in determining 'injury' in an antidumping case. The primary purpose of this paper is to examine the standard of injuries of domestic industry considering U.S. Antidumping Law.
