성범죄 피해자와 가족의 관점에서 본 신상공개제도의 평가 및 개선방안 = Victims' perspectives on Sex Offender Registration and Notification Regulations

국문 초록 (Abstract)

신상공개제도는 2000년 청소년의 성보호에 관한 법률의 시행으로 실시되었는데, 이 후 제도에 대한 법률적 검토 및 개정작업과 함께 학술적 논의도 활발하게 진행되어 왔다. 기존의 신상공개제도 관련 논의들은 관련 법적 쟁점들 - 과잉금지원칙에의 위배여부 및 평등원칙에의 위배여부, 고지제도의 소급적용의 문제 등 - 에 초점이 맞추어져 왔고, 제도에 대한 인식 및 실증 연구들은 일반인의 신상공개제도에 대한 인식 및 이로 인한 행동변화 등에 주목하였다. 일반국민의 알권리 보호의 중요성과 이를 통한 성범죄의 예방효과 등에 대한 논의가 비교적 활발하였던 것과는 대조적으로, 성범죄피해자 및 피해자가족 등에 대한 논의와 실증연구는 매우 부족한 실정이다. 본 연구에서는 선행연구의 한계점인 성범죄 피해자의 신상공개제도에 대한 의견조사의 부재를 보완하기 위해 성범죄 피해자 및 그 가족들의 관점에서 현행 신상공개제도에 대한 평가 및 개선방안에 대한 의견을 살펴보고자 하였다. 조사결과, 성범죄 피해자 및 가족들의 신상공개제도에 대한 인지도 및 필요성에 대한 인식은 비교적 높은 것으로 나타났으나 제도의 효과성에 대해서는 회의적인 의견이 많았다. 신상공개제도에 대한 개선방안으로는 열람 및 고지대상의 확대와 공개정보의 확대, 제도운영의 안정성 확보, 소급적용의 대상확대 및 피해자 대상 의무고지제도 도입 등이 지적되었다.

다국어 초록 (Multilingual Abstract)

This study involves an examination on 'sex offender registration and community notification regulations' in Korea focusing on victims' perspectives. Korean version of sex offender registration and community notification regulations are initiated in 2000 and regulations are modified several time since then. However, few empirical studies have been conducted, and thus little of the empirical studies reflected on the modification on the registration and community notification regulations. In particular, none of previous studies consider victims' perspectives on sex offender registration and community notification regulations, and victims' view on the regulations are not discussed and reflected on the modification of laws. Utilizing focus group interview with victims and their family members of sex crimes, the current study highlight several points for the adminstration and modification of policies such as the stability on the adminstration of the regulations, providing more extensive information on sex offenders for notification, the victims' rights for the information on sex offenders, etc. Policy implications are discussed with review of the law amendment on the sex offender registration and community notification.
