지방자치와 지방교육자치 통합의 주요 쟁점과 과제

국문 초록 (Abstract)

현행 지방교육자치제도는 교육의 발전이라는 본질적 논의보다는 독립(교육계) 대 통합(행정계) 이라는 소모적 논쟁을 이어오고 있다. 2010년 법 개정이후 주요 이슈는 완전 통합과 분리 그리고 교육감 선거로 요약될 수 있다. 행정계에서는 지방교육자치를 지방자치의 일부로 간주하고 통합의 효율성과 타당성을 주장하면서 교육감 직선제 폐지를 주장하고 있다. 한편 교육계는 교육위원 일몰제에 대한 우려와 함께 교육자치의 의미를 ‘교육의 자치’로 자주성과 전문성이라는 가치에 의미부여를 크게 하고 있다. 교육감 직선제 이후 교육감과 교육과학기술부나 광역자치단체간의 갈등양상은 지역의 교육발전과 화합보다는 지역의 행정계와 교육계 분열 우려를 낳고 있어 통합에 대한 논의의 필요성을 부각시키고 있다.
소모적 논쟁을 종식시킬 과제로 첫째 지방자치와 지방교육자치는 공통적으로 지역을 기반으로 하고 있는 공동체임을 인식하여야 한다. 교육감과 시도지사는 경쟁과 견제의 대상이 아닌 협력, 동반자로서의 관계 인식을 전제로 지역 교육에 대한 교육감과 시도지사의 관계와 역할을 명확히 하여 지역 교육에 대한 책무성을 가지도록 할 필요가 있다. 둘째, 교육감선출방식은 런닝메이트제나, 임명제, 시도조례로 선출하는 방안을 고려할 필요가 있다. 셋째, 재정의 자립도는 자치의 핵심이다. 따라서 중앙 수준에서 관리되고 배분되는 방식을 수정하여 지방으로의 이전이 필요하다. 넷째, 지역교육에 대한 지역 주민의 관심과 참여를 이끌기 위한 노력이 필요하다.

다국어 초록 (Multilingual Abstract)

The current local educational autonomy system continues to have an unnecessary dispute of independence(education part) versus integration(administration part) rather than an essential discussion for educational development. The main issues can be summarized as full integration and separation, and election of school district superintendent since the Revision of Law of Local Educational Autonomy system in 2010. Regarding local educational autonomy system as a factor of local autonomy, the administration part insists the efficiency and validity of integration and the abolition of direct election of school district superintendent. Meanwhile, with worry about the sunset system of educational committee member, the education part regards educational autonomy as autonomy for education and places a great deal of weight on the value of the independence and professionalism. The results of the study are as follows. The conflict among school district superintendent, department of education, science and technology, and metropolitan autonomy government give some worry about the breakup of the administration and education part at the local level. It raises the necessity of discussion about integration.
The following tasks are to put an end to unnecessary disputes. First, it needs to recognize that local autonomy and local educational autonomy are one community based on locality. With the recognition that school district superintendents and local governors have some relationship of cooperation and counterpart, they should have definite relations and roles on local education and some responsibilities for local education. Second, the way of election for school district superintendent needs to be considered the running mate or appointment system and regulations. Third, the independence degree of finance is the core of local autonomy. National tax has to be converted to local tax in order to turn up the independence degree of finance. Forth, an effort for leading the concern of local residents about the regional education and participation is needed.
