인권 딜레마 토론 수업이 법적관용성에 미치는 영향 = The Effects of Human Rights Dilemma Discussions on Legal Tolerance

국문 초록 (Abstract)

현재 한국사회에 만연해 있는 집단 간 혐오 문제는 학생들의 문화에도 직접적인 영향을 미치고 있다. 이에 본 연구는 혐오문제를 해결하기 위한 교육적 목표로서 법적관용성을 제시하였다. 그리고 이러한 법적관용성을 함양하기 위한 교수-학습 방안으로 인권 딜레마 토론 수업을 제안하였다. 이 수업은 인권 딜레마 상황이라는 내용 측면과 토론식 수업이라는 방법 측면의 특성으로 구성되어 있다. 또한 인권 딜레마 토론 수업의 핵심적인 경험으로 사회인지적 관점 채택의 요소를 반영하여 수업을 구안하였다. 이에 내용과 방법 측면에서 각각 대조를 이루는 인권의 도덕적 규범성을 강조하는 인권 설명식 수업과 법적관용성 함양에 미치는 영향을 비교하였다. 수업의 효과를 분석한 결과, 주가설과 세부가설을 모두 채택하고 인권 딜레마 토론 수업이 인권 설명식 수업에 비해 법적관용성 함양에 유의미한 영향을 미치는 것으로 나타났다. 이는 인권 딜레마 토론 수업이 학생들의 혐오문제를 해결하기 위한 교육목표로서 법적관용성을 함양하는데 효과적인 방안이 될 수 있음을 보여주는 것이다.

다국어 초록 (Multilingual Abstract)

The aspects of conflict in Korean society are also getting diverse. As can be seen in misogyny, hatred toward different regions, hatred toward different generations, and hatred toward different race, it is prevalent to regard certain groups as the others and express hatred. This study suggest legal tolerance concept as a educational objective to resolve the hatred problem. This is a study to suggest specific teaching-learning method in the aspect of contents and methods to raise legal tolerance, and tries to find out what kind of influence human rights dilemma discussion has on legal tolerance. In this goal, human rights dilemma relates to contents and discussion class relates to method. For these research questions, this study conducted multiple regression analysis to find out the influence of human rights dilemma discussion on legal tolerance. As a result of analysis, both the main hypothesis and particular hypothesis of this study that human rights dilemma discussion is more effective in raising legal tolerance than lecture-based class. The result of multiple regression analysis showed that as for the domain of rights including human rights, it is effective to suggest a situation of legal and moral dilemma and adopt discussion-type class in raising legal tolerance. Through the discussions made in this study, it is expected that there will be various discussions in school on the contents, methods, and teaching materials of human rights education.
