교권 회복과 학교폭력 대응을 위한 관련 법령 및 학교체육의 비판적 담론 분석 = A Critical Discourse Analysis of Related Statutes and School Physical Education to Restore Teacher’s Rights and Respond to School Violence

국문 초록 (Abstract)

본 연구는 교육 현장 속 학교폭력 해결 과정을 관련 법령에 기반해 분석하여 교권 회복과 학교폭력 대응을 위한 학교체육의 역할을 탐구하는 데 목적이 있다. 연구방법은 체계적 문헌고찰 방법을 활용해 2025. 6. 15.일자 기준 현행 헌법과 교육기본법, 학교폭력예방법 등 총 7개 법령을 수집했다. 이후 법 해석 및 적용 원칙에 기반해 내용분석 후 개방 코딩으로 범주화했고, 해석 과정에서는 비판적 담론 분석을 활용했다. 연구결과에 따르면 첫째, 학교폭력 처리 절차는 사후 대응 성격을 가지고 있으며, 대응 절차에서 교육적 요인이 사라지고 있었다. 둘째, 교권은 기본권과 구분되어 교수⋅연구활동에 관한 보장이 취약하며, 학생지도활동은 계속 보완되고 있었다. 셋째, 학교폭력 책임교사는 제도적 조치보다 교육적 완화가 필요함을 언급했다. 이를 토대로 학교폭력 처리 절차의 교육적 기능 회복을 위해 체육교사 및 체육수업의 역할을 관계회복 프로그램에 기반해 논의했다. 연구결과 및 논의를 바탕으로 학교 현장 분석, 타교과와의 융합, 법 적용 사례 연구의 필요성을 제안했다.

다국어 초록 (Multilingual Abstract)

The purpose of this study was to explore the role of physical education in restoring teachers' authority and responding to school violence based on statutes related to school violence resolution process. Using the method of systematic literature review, the current 1 constitution and 6 acts were collected as of 15th June, 2025. After that, it was categorized as content analysis and open coding, based on principles of law interpretation and application. Also, critical discourse analysis was used for interpretation. The results of the study were as follow. Firstly, the structure of school violence resolution process was post-treatment, and educational factors were disappearing from the response procedure. Secondly, teacher's rights were distinguished from fundamental rights, and teaching & research activities were weak, but student guidance activities continued to be supplemented. Thrdly, the responsible teacher for school violence mentioned the need for educational relaxation rather than institutional measures. After that, based on the relationship recovery program, the role of physcal education in restoring the educational function of the school violence resolution process was discussed. Drawing on the findings and discussion, school field analysis, convergence with other subjects, and law application case studies are suggested.
