채움의 권리－실질적 자유 논의를 토대로 한 아동 권리의 상호연계적 실현 원리 탐색－ = Rights as fulfilling: Exploring principle for the interdependent realization of human rights based on discussions of substantive freedom

In reality, the practical implementation of human rights laws, including the United Nations Convention on the Rights of the Child, is insufficient. The purpose of this study was to explore the reasons why human right agents should be practical doers striving to realize human rights for their community and, thereby, derive a principle for substantively realizing equal rights for all. Thus, we examined discussions of Feinberg, Rawls, Sen, and Nussbaum, who have attributed the limited realization of human rights to a lack of opportunities and abilities to enjoy freedom. In addition, we examined the concept of interdependence of human rights, which implies that opportunities and abilities can be increased through the interdependent practice of duty and cooperation. Consequentially, we uncovered the principles of realizing substantive rights and equality. We found that rights are realized with opportunities and abilities, and that the community should, at the very minimum, help children maintain human dignity so that they can eventually realize their rights. The realization of human rights is not only the responsibility of the nation but is also among our everyday responsibilities. The results of this study offer a new perspective on the importance and principle of welfare and provide policy implications for the field of childhood education

국문 초록 (Abstract)

이 글은 UN아동권리협약을 포함한 명문화된 각종 법이 현실에서 실천되지 않는 한계를 극복하고자 권리의 주체들이 공동체적 권리 보장을 실천해야 하는 이유와 실질적으로 평등한 권리를 실현할 수 있는 원리를 파악하고자 한다. 이를 위해 권리의 실현이 어려운 이유를 기회와 능력의 결핍으로 본 실질적 자유의 주장자인 Feinberg, Rawls, Sen, Nussbaum의 논의를 탐색하고, 결핍된 기회와 능력은 개인 상호간의 의무와 협력을 통해 증진된다는 권리의 상호연계성 개념을 살펴본다. 그리고 실질적 자유 개념과 권리의상호연계성 개념을 종합하여 권리의 평등을 실질적으로 실현할 수 있는 원리를 도출한다. 그 결과 실질적 자유는 기회와 능력이 갖추어졌을 때 실현되며 그것이 부족한 아동을 위해 공동체는 재능의 기부, 의무의 실천을 통해 아동의 현재의 능력 수준과 존엄의 최저 선 사이의 간극인 잠재적 역량수준을 채움으로써 아동이 최소한의 존엄을 유지하고, 실질적으로 권리를실현할 수 있게끔 도움을 줄 수 있음을 알 수 있었다. 이 글은 기회와 능력의 상호연계적 채움 논의를 통해 인간 권리의 실현이 국가의 의무만이 아니라 우리의 일상적 의무와 관련이 있고, 복지의 필요성과 원리에 대한 새로운 시각을 제공했으며, 아동복지정책에 대한 함의를 제공했다는 점에서의미가 있다.
