생성형 AI 시대 음악 창작 구조의 재구성과 창작 주체의 재정의 = Reconstructing the Structure of Music Creation and Redefining Creative Agency in the Era of Generative AI

국문 초록 (Abstract)

이 연구는 생성형 AI의 도입이 음악 창작 구조와 창작 주체 개념에 미치는 영향을 분석하고, 이에 따른 저작권 제도의 재정비 필요성을 고찰한다. Suno 플랫폼의 기술 구조와 사용자 인터페이스를 분석하고, 프롬프트 기반 음악 생성 실험을 통해 인간- 기계 간 창작 분담 구조를 탐색하였다. 아울러 미국과 한국의 저작자 정의 및 제도 비교를 통해 AI 창작물의 법적 지위를 검토하였다. 연구 결과, 창작은 더 이상 단일 주체의 산물이 아닌 다층적 참여의 결과로 이해되어야 하며, 이에 기반한 기여 중심 저작권 판단 체계의 제도화가 요구된다.

This study examines how the advent of generative AI is reshaping the structure of music creation and redefining the concept of creative agency, while also assessing the need for corresponding reforms in the copyright system. The technical framework and user interface of the Suno platform are analyzed, and a prompt-based music generation experiment is conducted to explore the division of creative labor between human and machine. Furthermore, a comparative legal analysis of authorship definitions and copyright systems in the United States and South Korea is undertaken to assess the legal status of AI-generated works. The findings suggest that creation should no longer be viewed as the product of a single author, but rather as the outcome of multilayered participation, thereby necessitating the institutionalization of a contribution-based framework for copyright attribution.
