국제법상 인도적 개입 : 그 개념, 합법성 및 성문화에 관한 논의를 중심으로 = Humanitarian Intervention in International Law - Its Concept, Lawfulness and Codification

국문 초록 (Abstract)

인도적 개입은 무력사용을 수반하여 타국 내의 인도적 위기에 대한 강제개입이란 점에서 국가주권, 국내문제불간섭, 무력사용금지의 원칙과 조정을 요하는 문제를 내포하고 있어, 국제법에서 아주 어려운 문제들 중 하나이며, 그 합법성 여부는 오랫동안 논의의 대상이 되었다.
이 논문의 목적은 국제법의 목적과 인권보호를 위해서는 복잡한 인도적 위기를 다루는 명확히 정의된 규범이 있는 편이 그러한 규범이 없는 편보다 더 바람직함을 보여주는 것이다. 이를 위해 인도적 개입에 관한 규범을 성문화할 때의 장점, 성문화의 방법과 성문화 대상인 실체적 · 절차적 기준을 검토한다. 그러한 검토의 결과는 다음과 같다. 첫째, 성문화에는 앞서 언급한 원칙들과 인권의 조정과 같은 많은 어려움이 있을 것으로 예상되지만, 장기적으로 많은 장점도 있다. 즉, 성문화를 할 경우, 장기적으로, 인도적 개입의 남용(특히 위장개입)을 방지하고, 국제법의 규범성과 정당성을 높이고, 국가주권을 보전할 수 있다. 둘째, 성문화되는 규범에 포함해야 할 기준(성문화되는 규범의 내용)은 규범적으로 바람직해야 한다. 셋째, 성문화를 할 경우 오히려 일방적 개입이 합법적으로 남용될 가능성이 높아진다는 우려가 크다는 점을 감안할 때, 그리고 이러한 우려를 불식시켜야 성문화의 반대를 줄일 수 있다는 점을 감안할 때, 성문화를 할 경우에는 엄격하고 명확한 기준을 설정해야 할 것이다.

다국어 초록 (Multilingual Abstract)

This article argues that it is mote desirable to have a rule of humanitarian intervention(in particular, unilateral humanitarian intervention) capable of dealing with complex humanitarian crises, rather than the absence of a clearly defined rule, for the purposes of international law and the protection of human rights. For this argument, this article reviews the advantages of codifying a norm of unilateral humanitarian intervention, the ways in which such norm could be codified, and substantive or procedural criteria that should included in a codified norm. Of course, it is expected that there exist many difficulties in codifying, such as the reconcilement between the principles of state sovereign, the non-intervention and the non-use of force, and those of human rights. Despite such difficulties, this article points out, the advantages the codification of a norm of this area of international law holds in the long term. That is to say, the codification will be able to prevent abusive interventions(in particular, the pretextual intervention), enhance the normativity and legitimacy of international law, and preserve state sovereignty. Also, this article points our that the content of a codified norm must be normatively desirable, and that codifying strict and clear criteria is more appropriate in context of unilateral humanitarian intervention, given that the fear of abuse of unilateral intervention is particularly acute, and that codifying strict criteria would be less controversial. In addition, this article deals briefly with the concept and lawfulness of humanitarian intervention.
