교육의 정치적 중립성의 헌법 편입과 제도화 연구 = A Study on the Political Process of Incorporating ‘Political Neutrality of Education’ into the Constitution and its Institutionalization

국문 초록 (Abstract)

이 연구는 교육의 정치적 중립성이 헌법에 편입된 정치과정(political process)에 대한 분석을 바탕으로 그 제도화 양상과 실천적 의미를 드러내는 데 목적을 두고 있다. 이를 위해 선행 연구에 대한 검토를 시작으로 제헌의회에서 국가재건최고회의에 이르는 기간의 헌법 제･개정 및 교육의 정치적 중립성 관계 법령들의 연혁 분석에 주력하였다. 또한 헌법재판소의 결정례와 대법원의 판례를 살피는 한편, 대한교육연합회(이하‘대한교련’으로 줄임)의 간행물과 1960년대의 연구자료 등으로 일차 사료의 망실에 따른 공백을 메우려는 노력을 기울였다. 고찰 결과를 요약하면 다음과 같다. 첫째, 교육의 정치적 중립성의 헌법 편입은 ⑴ 정통성이 취약한 군사정권과 ⑵ 교육(학)계 보수세력의 동맹(coalition)의 산물이라는 사실을 알게 되었다. 정치적 지지기반을 확충하기 위해 군사정권이 큰 틀에서 대한교련의 건의를 수용하되 나름의 셈법에 따라 ‘교육의 정치적 중립성’이란 모호한 문언을 헌법에 편입시킨 것이다. 둘째, 교육의 정치적 중립성의 제도화는 ⑴ 교원의 정치적 기본권 제약 규범, ⑵ 지방교육자치의 탈정치화 규범 측면에서 두드러진 모습이었다는 사실을 확인할 수 있었다. 전자의 경우 교육기본법(← 교육법), 공무원법(← 교육공무원법) 등을 기본으로 정당법, 사립학교법, 교원노조법 등이 큰 역할을 하였다. 후자의 경우 교육법 개정과 지방교육자치법의 제･개정을 통해 ‘제도의 탈정치화’로 집약되는 제도화를 이뤄냈다. 셋째, 교육의 정치적 중립성의 실천적 의미는 국가와 교육(학)계 보수세력의 교육 지배로 요약될 수 있다는 사실을 깨닫게 되었다. 이 문언이 양자 간의 동맹을 가능케 한 최상위 법 규범으로 작용하는 한편, 국가와 교육 전문가들의 교육 지배를 정당화하는 이데올로기 역할을 해 온 것이다. 제도화를 거쳐 교사 배제의 교육 거버넌스 시스템을 구축하고 국가와 교육전문가의 정책 독점을 실현함으로써 가능한 일이었다.

다국어 초록 (Multilingual Abstract)

This study aims to reveal the aspects of institutionalization of ‘political neutrality of education’(PNE) and its practical implications through analyzing the political process of incorporating PNE into the Constitution. For this purpose, the author focuses on the diverse materials, which are the historical documents of Constitution revision, related laws making and their revision, the decision cases of Constitutional Court and Supreme Court, and the second historical materials. The results of this study are as follows. Firstly it is found that the incorporation of PNE into the Constitution is the product of coalition between illegitimate military government and conservative forces of education in Korea. Secondly the author finds that the institutionalization of PNE are prominent in ⒜ the norm for blocking the teachers’ political rights, ⒝ the norm for the depoliticization of local education autonomy. Thirdly the author recognizes that the practical implications of the institutionalization of PNE is the domination of education which is stemmed from teachers-proof governance system and policy monopoly of state and educational professionals.
