개인정보 도용의 문제가 사회적으로 심각한 상황에 직면하여 법원 역시 그간에 기재하여온 주민등록번호를 판결문에 기재하지 않기로 하는 제도적 변화를 겪고있다. 그러나 우리 법 제도에서 주민등록번호는 바로 “그” 사람의 실체적 권리와 긴밀히 연결되고 등기와 같은 공시제도에 반영되어 판결의 집행을 위하여 필수불가결한 개인정보이다. 이에 주민번호와 같은 개인정보를 보호하면서 판결의 집행이라는 유기적 작업을 완수하는 조화로운 법의 운용이 필요하게 되었다. 이를 위하여 미국의 법 운용을 검토하여 이를 참고하고자 한다. 미국은 그러나 우리와 달리 법원의 기록은 광범위하게 대중에 공개되어야 한다는 강한 명제의 지배하에 있다. 따라서 법원의 기록을 통하여 개인정보가 누출될 위험이 매우 높고, 실제로도 개인정보는 법원 기록과 재산 기록에 의하여 가장 빈번히 노출된다고 한다. 캘리포니아 주 법원은 법원의 기록에 SSN과 같은 개인정보를 편집할 의무를 부여하고 당사자의 책임 하에 개인정보가 노출되지 않도록 운용하고 있다. 파산 절차의 경우 사건의 공익적 성격 및 전자적 공시에 의하여 개인정보의 우려 노출위험이 더 크다고 할 수 있는데, 법원은 SSN 노출을 줄이 면서도 당사자의 SSN 제출 및 법원의 정보 확보가 진정으로 필요한 경우를 강구 하여 이 경우에 제한적으로 정보를 제출하도록 하고, 그 정보는 별도의 양식에 기재하고 여타의 기록과 따로 보관하는 방법으로 정보 유출의 위험을 막고 있다. 한편, 우리에게 생소한 미국의 집행절차를 개관하고 이 절차에서 SSN이 기재되는 경우를 살펴보고, 그 이유를 추론해 보았다. 주민번호와 관련한 우리 법원의 업무를 살펴보고 끝으로 두 나라의 제도의 차이를 집어본 다음 우리 법제 하에서 그럼에도 불구하고 개인정보를 확보할 필요성이 있다는 결론을 도출하였다. 다만, 사적 영리 추구 주체가 아닌 법원이 그 관리에 있어서 더욱 세심한 주의가 필요 하며 이를 위한 제도적 기반이 절실함을 지적하였다.

다국어 초록 (Multilingual Abstract)

Identity theft crimes are getting more serious these days. Courts made a decision not to write a party's residential number in a judgment document. However, in our legal system, identification number is substantially connected with a person's right and reflected in registration system as well. Judgment execution is also closely associated with such number. As such, we confront a situation that we have to keep good balance between court practice and privacy protection. For this, I would like to refer to the U.S. system to find out a
desirable guideline for our system. We have to keep in mind that very strong belief that court records should be
disclosed to general public controls in the U.S. system. A survey says that private information such as SSN is most frequently leaked by such court records and asset records. Court rules impose responsibility for redaction on a party. In a bankruptcy court, court records are more widely disclosed so relevant rules are devised carefully on whether and when the party shall submit his/her whole SSN to court. The U.S. Courts prepare separate form for this and maintain such sheet separately from other records. I look at the general court
execution process which is quite new to us, find cases where a party's SSN is expressed and think about the reason why. I also compare our residential number with the U.S. SSN. All these review leads me to reach conclusion that a party's residential information is important and necessary to our court practice. We should never forget the importance of prevention from leaking these information.
