한국의 사회보장법과 비정규직 고용 = 공공선택의 시각에서

국문 초록 (Abstract)

노동제도가 미처 정비되지 않은 국가에서 노동시장 유연화 정책은 탈법적 관행을 더욱 부추길 수 있고 노동시장 유연화로부터 기대되는 경제효율성이 반감될 수 있다. 본 연구는 노동시장 유연화 정책수단의 중요한 한가지인 비정규직 고용규제의 완화가 노동계약에 미치는 효과를 실증분석 한다. 실증분석 결과는 부실한 근로감독체계와 모호하게 설정된 법조항과 같이 비정규직 관련 노동제도의 불완전성은 사용자의 노동-관련법상의 정당의무를 회피할 수 있는 창구로 활용될 수 있음을 시사한다. 본 연구는 이러한 제도상의 불완전성이 왜 방치될 수 있는가를 공공선택의 시각에서 분석한다.

다국어 초록 (Multilingual Abstract)

This study argues that in countries having institutional insecurity, policies for labor market flexibility may cause social security law-dodging practices on the part of employers to rise and that as a consequences, the hoped for gains in efficiency are lessened. This study provides empirical examination of a cornerstone in the Korean government"s policies on labor market flexibility; the liberalization of the legal restraints for hiring irregular workers. The empirical results suggest that these loop-holes, a poor monitoring system and ill-defined legal terms loopholes appear to provide an excellent breeding ground or "hotbed" for extensive opportunism. From a perspective which relies on public choice theory, this study explores reasons for the lax enforcement of social security law for irregular workers in Korea.
