북한 인권문제에 대한 인도적 개입유형의 적용: 국제법상 접근을 중심으로 = The Application of Humanitarian Intervention Types for the Problem of Human Rights in the North Korea : Focusing on an Approach Under the International Law

The purpose of this study is to investigate the types of humanitarian intervention to force the government of the North Korea which has no intent or capability on its human rights for itself, to improve human rights problems. First, this study focused on exploring meaning of means other than an existing compulsory intervention mainly fixed on the use of force. Second, the study also focused on analyzing types of humanitarian intervention that are able to force the government of the North Korea to have a will to solve its human rights problem on its own. On this process, the study considered three factors; problems of permission under the international law, coerciveness, inductive accessibility. There are five intervention types deducted from this study; military, political, economical, socio-cultural, institutional intervention.
This study evaluates the utility of these humanitarian intervention types separately at a viewpoint of theory and reality, also mutually compares their applicability and order of priority by a method of comparison. In its final analysis, military intervention which replaces the notion of existing humanitarian intervention was assessed to be an approach that has the least applicability and an order of priority. This is because of two factors. One is a controversy over a permissible range under the international law ,and the other is that existing military force of the North Korea is dangerous level at a threatening conditions. This shows the limitation of intervention policy that military intervention should function as a last resort to North Korea.
In a sense, besides the use of force, economical, institutional intervention and partially socio-cultural intervention were evaluated as useful humanitarian interventions. This evaluation shows that not only policy under the permission of the international law but also forcibleness and accessibility should be regarded as an important way of approaching to the problem of human rights in the North Korea at the same time. Also the category of humanitarian intervention includes various means without the use of force. So this study considers humanitarian intervention as an available way of approach to solve human rights problems in the North Korea.

국문 초록 (Abstract)

본 연구의 목적은 북한 인권문제를 스스로 해결하고자 하는 의지나 능력이 결여된 북한정권에 대하여, 이를 강제할 수 있는 ‘인도적 개입’의 유형들을 고찰하는 것이다. 이를 위해 연구중점은 첫째, 기존의 무력사용 위주로 국한된 강제개입보다 무력사용 이외의 수단적 의미를 탐색하는 것이며, 둘째, 북한 인권문제에 대해 북한정권의 자발적인 해결의지를 강제할 수 있는 접근방법들을 분석하는 것이다. 그리고 연구과정에서 국제법상 허용문제, 강제성, 그리고 유도적 접근성 등 세 가지 요소를 고려하였다. 이를 통해 도출한 개입유형들은 군사적․정치적․경제적․사회문화적․제도적 개입 등 다섯 가지이다.
이러한 개입유형에 대하여 이론과 실제의 관점에서 개개의 유용성을 검토하고, 적용 가능성과 우선순위를 단순비교방법으로 평가하였다. 그 결과, 기존의 인도적 개입 개념을 대신하는 군사적 개입은 이론과 실제 모두에서 적용성과 우선순위가 가장 낮은 접근으로 나타났다. 이는 국제법상 허용범위에 대한 이견 그리고 북한의 실존 군사력이 위험수준이라는 변수들이 주요 이유로 작용하기 때문이다. 즉 군사적 개입은 최후의 수단으로서만 기능해야 한다는 한계를 보여 주는 것이다.
그러나 무력사용 이외의 수단인 경제적․제도적 개입, 그리고 일부지만 사회문화적 개입은 유용한 접근으로 평가하였다. 이는 북한 인권문제를 접근하는데 있어서 국제법상 허용을 준수하되, 강제성과 접근성을 모두 중시해야 한다는 것을 보여주는 것이다. 그리고 인도적 개입의 범주를 무력사용 이외의 수단적 의미들을 포함한다면, 본 논문은 인도적 개입정책이 북한 인권문제 개선에 유용한 대안이라고 평가하였다.
