장애인스포츠 실업팀 활성화를 위한 법,제도 개선 방안 = Reform Strategy of Legal and Institutional Infrastructures to promote the Business-Sponsored Sport teams for Individuals with Disabilities

국문 초록 (Abstract)

이 연구는 장애인스포츠 선수들의 직업안정성 도모를 위한 장애인스포츠 실업팀 활성화의 기초자료를 제공하는데 목적이 있다. 이를 위해 우리나라 장애인스포츠 실업팀의 운영현황과 실태를 알아보고 실업팀 활성화를 위한 법·제도 개선 방안을 제시하고자 하였다. 연구방법으로는 문헌조사와 면접조사 그리고 전문가 회의를 실시하였다. 문헌조사와 담당자 면접조사를 통해서 현재 국내 장애인스포츠 실업팀 운영 현황과 실태를 조사하였으며, 운영의 근거가 되는 관련조례, 규정 등을 파악하였다. 또한 창단과 운영의 근거가 되는 상위 법령과의 비교검토를 통해 문제점을 파악하였다. 특히, 장애인체육을 전공한 대학교수 3명과 장애인체육행정가 2명으로 구성된 전문가 회의에서는 장애인스포츠 실업팀 활성화에 대한 법·제도의 한계와 개선방안을 도출하였다. 또한, 연구의 방향성을 논의하고 현행 법·제도의 검토를 바탕으로 한 문제점을 진단하였으며, 개선방안에 대한 논의 및 검토과정을 거쳐 최종 개선방안을 도출하였다. 첫째, 장애인실업팀에 대한 별도규정이 있는 경우, 선수개인의 사회보장 혜택을 강화하는 조항을 추가해야 한다. 둘째, 장애인실업팀에 대한 별도조항이 있는 경우, 장애인스포츠 실업팀의 운영·관리·지원문제를 명확히 하여 장애를 가진 선수들의 접근성과 이동권을 보장하는 조항이 구체적으로 마련되어야 할 것이다. 셋째, 장애인실업팀에 대한 공통규정이 있는 경우, 장애인선수 특성에 맞는 시설과 용·기구지원 등 훈련환경 제공에 대한 구체적인 내용을 규정할 필요가 있다. 넷째, 장애인실업팀에 대한 규정이 마련되지 않은 미규정의 경우 장애인스포츠 실업팀 설치근거를 마련하되, 실업팀 육성·지원 조항, 시설의 설치·운영 조항, 복무 관련 조항 등 세밀한 관련조례와 조항이 마련되어져야 할 것이다.

다국어 초록 (Multilingual Abstract)

This study has for its object to offer the basic materials of invigorating the business-sponsored sport teams for individuals with disabilities to promote the job stability of the disabled athletes. With this in mind, we investigate the operation status and actual conditions in the business-sponsored sport teams for individuals with disabilities and present improved ways in legislation and system in order to grow the business-sponsored sport teams for individuals with disabilities. Study methods of documentary research, interview and experts meeting were conducted. Through documentary research and interview with the person in charge, we researched the operation status and actual condition on the current domestic business-sponsored sport teams for individuals with disabilities and learned the ordinance and regulation at the base of operation. Also, we understood the problems by comparing and analyzing with high regulations at the base of foundation and operation. In the experts meeting with two university professors specialized in physical education for the disabled and two disabled sports administrators, we drew betterment for the limit of the legislation and system regarding invigoration of the business-sponsored sport teams for individuals with disabilities. Especially, we discussed the directions in research and diagnosed the problems of the current legislation and system. Through the process of discussion and examination regarding the improvement, the following reform strategies are suggested. (a) If there is a separated regulation, an article to strengthen the benefits of social security for the athletes with disabilities should be included. (b) if there is a separated article, clarify the system of operation, management, and support of the business-sponsored sport teams for individuals with disabilities and make a detailed article to guarantee the accessibility and mobility of the athlete with disability. (c) If there is a common regulation, we need to define the detailed contents to provide customized facility, equipment and training environment for the athlete with disability. (d) If there is no regulation, prepare the establishment basis of the business sports team for the disabled and it requires very detailed ordinances and articles on promoting and supporting the business team, facility installation, operation and military service.
