책임의 역설과 행정악(行政惡)의 문제: 마이클 하몬의 행정담론을 중심으로 = The Paradoxes of Responsibility and the Problems of Administrative Evil in Michael Harmon’s Theories

In this article, I attempt to articulate the problems of so-called administrative evil by focusing upon two paradoxes developed in Michael Harmon’s critique of rational discourse on government. It is to analyze the inevitability of contradiction and opposition generated by antinomial paradoxes and schismogenic paradoxes. What Harmon call ‘antinomial paradoxes’ embody the notion that contradiction and opposition are inevitable features of human existence. Meanwhile, schismogenic paradoxes reflect some failure to see situations as unavoidably involving contradiction or oppositional aspects. These paradoxes have both positive and negative connotations despite that both the “good” ones and the “bad” ones embody the notion of opposition between polar ideas. For criticizing the rational discourse on administrative responsibility, I will mainly approach the two cardinal elements of personal responsibility, i.e., self-reflexivity and human relationship that presuppose the other.

국문 초록 (Abstract)

일반적으로 공직윤리에서의 책임은 두 가지의 다른 의미, 즉 개별 공직자가 떠안아야 할 도덕행위의 의미와 정당한 정치권위에 대한 책임을 나타내는 역설적 개념이다. 이 논문에서 필자는 신행정운동의 선구자인 마이클 하몬의 행정담론에 의거해서 모든 행위자가 거의 필수적으로 받아들여야 하는 두 역설에 주목하면서 ‘행정악’(the administrative evil)의 문제를 끌어내고자 한다. 이른바 그가 제시한 “이율배반의 역설”(antinomial paradoxes)과 “자기분열발생의 역설”(schismogenic paradoxes)에서 발현되는 모순과 대립을 분석하고자 하는 것이다. 하몬에게 이율배반의 역설은 개인이 내적 대립을 통합하려는 투쟁과정으로서 전체적 인간조건인 반면에, 자기분열발생의 역설은 서구사회에서 상반된 원칙들 사이에서 발생하는 내재적 긴장의 상처로 인해 뻔히 보이는 병리현상을 낳게 되는 합리성 과정의 일부로 이해된다. 그는 전자를 “선한 역설,” 후자를 “악한 역설”이라 부른다. 이러한 맥락에서 이 연구는 행위주체의 이율배반에 기반을 둔 개인의 책임을 근대조직의 기본적인 대립구도의 측면에서 접근하고자 한다. 서론에 이어 제II절에서는 행정책임과 윤리적 의사결정에 대한 합리주의 가설을 살펴보고, 제III절과 제IV절에서는 책임의 역설적인 성격을 규명한 다음 여기서 발생하는 행정악의 문제를 논의할 것이다. 마지막으로 공공조직 내 “책임의 역설”에 의거한 하몬의 통찰이 갖는 윤리적 함의를 도출하고자 한다.
