제4차 산업혁명 시대의 공간정보 법제의 동향 = Legislative Trend related to Spatial Data in the Era of the 4th Industrial Revolution

국문 초록 (Abstract)

현재 4차 산업혁명과 관련하여 공간정보 법제에 대해서 다양한 법제화 또는 입법화 방안이 나오거나 나올 것이다. 그런데 공간정보 법제는 4차 산업혁명 시대 도래 초기부터 4차 산업혁명이라는 표현을 쓰지는 않았지만, 제4차 산업혁명의 개념으로 볼 수 있는 융합 정보기술에 의한 산업의 대변혁이라는 관점에서 기본적으로 정보의 통일화, 공개화, 네트워크화가 필요한데, 공간정보 법제의 중요 법률들은 종래부터 이러한 요소들에 대한 법제개선을 시도하여 왔고, 발전하고 있다고 할 것이다.
다만, 4차 산업혁명 시대에 있어서 공간정보 법제 개선 방향성과 관련하여서는 4차 산업혁명 시대의 법제화 방향과 그 궤를 같이 한다고 할 것이다. 예컨대, 첫째, 4차 산업혁명 시대에 있어서는 Negative 규제방식의 확대 적용뿐만 아니라 개인정보 및 공공적 위해가 있는 경우를 제외하고는 공간정보의 국민 등에 대한 접근성이 용이하여지게 할 필요가 있다.
둘째, 새로운 사업모델과 법제도 정비의 관점에서 플랫폼 비즈니스 및 공유경제와 ICT기술 결합 관련 법제 정비라는 방향성과 관련하여 공간정보 산업의 플랫폼 비즈니스를 위해서는 정보의 허브기능을 할 수 있는 기관 등의 설치 및 절차에 대한 논의가 필요할 것이고, 또한 공간정보의 민영화에 대한 고려에 있어서는 공유경제적 측면의 고려가 전제되어야 할 것이다. 그리고 ICT기술과의 결합으로 인한 의사결정 구조에 대한 고려도 필요할 것이다.

다국어 초록 (Multilingual Abstract)

There are and there will be various laws or ideas of legislation on spatial data when we talk about the 4th industrial revolution. Legislation on spatial data and major laws related to spatial data, however, have been striving to improve factors that unifies, opens, and networks data which is imperative for industrial revolution by conversion technology (which is the concept of the 4th industrial revolution), even before the expression “4th industrial revolution” had started being in use in the beginning of the 4th industrial revolution, When it comes to setting up a direction of the improvement of legislation on spatial data in the era of the 4th industrial revolution, it would be safe to say that the direction should go in parallel with a legislative direction of the 4th industrial revolution. First, for instance, the access to spatial data by the public must be easier in the era of the 4th industrial revolution, unless any damage to the public or personal data is posed, not to mention the extensive application of negative regulation.
Second, when we think of a direction of amending legislation on combining platform business and sharing economy with ICT from a perspective of new business model and improvement of related laws, we need to discuss on the establishment of and the procedure of establishing an organization that can act as a hub of data for platform business of spatial data industry. We also need to contemplate the side of sharing economy when considering of the privatization of spatial data. It is also imperative to consider the structure of decision making resulted from the combination with ICT.
