독일 부동산등기법상의 지목에 관한 소고

국문 초록 (Abstract)

공간정보로서 지적공부에 등록되는 지목은 전 국토의 토지이용현황을 파악할 수 있는 주요 지표임에도 불구하고 토지관리를 위한 기본정보로서의 역할을 제대로 수행하지 못하고 있다. 여러 원인이 있을 수 있으나 가장 근본적인 원인으로 들고 있는 것은 현행 우리나라의 지목이 평면적인 28개의 법정지목으로 규율되어 있다는 점이다.
이에 다양한 토지이용현황을 파악할 수 있도록 지목의 수를 보다 세분하여 확대·개편하여야 하며, 그 분류체계도 평면적 지목체계에서 다층적 지목체계(MultiLevel System)로 개편하여야 한다는 주장이 지속적으로 제기되어 왔다. 그리고 이러한 주장은 대부분 독일의 지목체계를 그 근거로 들고 있다. 본고는 우리지목제도의 개선을 위한 하나의 방안으로서 제기되는 독일지목제도에 관하여 살펴보았다. 특히 독일의 지목제도는 등기부상의 지목인 “Wirtschaftsart”와 지적공부상의 토지이용현황인 “Nutzungsart”의 이원적 체계로 이루어지고 있는데 본고에서는 등기부상의 지목인 “Wirtschaftsart”를 중심으로 살펴보았다.
본고가 제시한 독일의 등기부상 지목에 관한 연구내용이 향후 지목체계 개편을 위한 단초가 되기를 기대해 본다.

다국어 초록 (Multilingual Abstract)

Although the land category registered in the cadastral record as spatial information is a key indicator for grasping the land use of the entire country, it does not function properly as basic information for land management. There may be many causes, but the most fundamental reason is that the current Korean land category is regulated by 28 simple land category. Accordingly, it has been continuously argued that the number of land category should be further expanded and reorganized in more detail to identify various land use, and that the classification system should also be reorganized from a simple system to a multi-level system. And most of these claims are based on the German land category system. This paper examined the German land category system, which is proposed as a way to improve the Korean land category system. In particular, German land category system consists of a dual system of "Wirtschaftsart," the registered German land category, and "Nutzungsart," the land use of cadastral record. In this paper, we looked at the center of "Werschaftsart," the registered German land category.
We hope that the research on the German land category system proposed by this paper will serve as a starting point for the reform of the system in the future.
