미세먼지, 생명권에 대한 책무성 = Fine Dust, Accountability for the Right to Life

국문 초록 (Abstract)

본 연구는 미세먼지의 위해로부터 생명권 보장을 위한 개인·사회·국가적 책무를 모색해보았다. 오늘날 미세먼지는 단순한 대기오염 차원이 아니라 생명의 존엄성과 삶의 질을 파괴하는 침묵의 살인자로 다가왔다. 이는 헌법상 보호받아야 하는 ‘기본권 전제조건의 보호’로서 논의된다. 국민은 누구나 건강하고 안전하며 쾌적한 생활을 지탱 할 조건으로서 좋은 환경을 향수 할 권리를 가진다. 즉 환경권 차원에서 헌법상의 의의를 확인하는 것이다. 띠라서 국민 모두 환경권으로서 생명권 보장을 위해 미세먼지에 대한 책무가 요구된다. 본 고에서는 우선 개인적 책무로서 모든 생명체의 생명 의지를 존중하고, 인간의 이기심과 자본주의의 편리함에 길들어진 태도를 경계한다. 다음으로 사회적 책무로서 사회적 자본을 토대로 사회적 합의를 통한 협동적 네트워크의 작동을 주목하였다. 마지막으로 국가적 책무로서 국내외 구분하여 살펴보았다. 국내적 차원에서는 미세먼지에 대한 과학적 실태 파악 및 배출원 조사, 국가에너지 정책에 대한 로드맵 구축, 정책의 우선순위를 제시하였다. 국외적 차원에서는 외부로부터 오는 미세먼지 경로와 발생원 및 발생량에 대한 과학적 조사를 통한 적극적 대응, 동북아 다자협약 수립을 통한 국제공조의 강화를 제안하고 있다.

다국어 초록 (Multilingual Abstract)

This study sought personal, social, and national responsibility for guaranteeing the right to life from the hazards of fine dust. Today, fine dust has come to be a murderer of silence that is not just a measure of air pollution, but destroys the dignity of life and the quality of life. This is discussed as protection of Basic rights prerequisites that must be protected by the Constitution. Everyone has the right to enjoy a good environment as a condition to maintain a healthy, safe and comfortable life. In other words, it confirms constitutional significance at the environmental level. Therefore, all citizens are obliged to take responsibility for fine dusts as an environmental right to guarantee the right to life. In this article, first of all, as a personal responsibility, we respect the Life’s will of all creatures and watch out for the attitude of human selfishness and tame to the convenience of capitalism. Next, attention was paid to the operation of cooperative net-works through social consensus based on social capital as social responsibility. Lastly, I examined the domestic and international responsibilities as a national responsibility. At the domestic level, we have identified the scientific status of fine dusts, investigated the source of emissions, established a roadmap for national energy policy, and suggested policy priorities. At the international level, it proposes active response through the scientific investigation of the micro dust path, sources and generation from the outside, and strengthening of international cooperation through the establishment of multilateral agreements in Northeast Asia.
