한중 인터넷상에서의 저작권 규제 현상 연구: <소리바다>와 <산미엔샹(三面向)>을 중심으로 = A Study on the Regulation of Korean and Chinese On-line Copyright: Centering on the Cases of the <Soribada> and the <Sanmianxiang>

The purpose of this study is to explore the culture regulation in the new cultural phenomena of Korean and Chinese on-line copyright. In order to analyze, research cases of the <Soribada> and <Sanmainxiang> at social issue in Korea and China. <Soribada> case represents social issue about on-line copyright from 2002 to 2007 in Korea, <Sanmainxiang> case is a important law-suit about on-line copyright from 2005 to now in China. This study research examines cultural regulation of on-line copyright in Korea and China, According to analyze interested parties in progress of cases, and to analyze dominant causes which influence judicial decision. Recently, even though different political establishment and law system between Korea and China, They have common phenomena in on-line copyright. Firstly, they positively join international copyright organizations after golobalization and open-market, and drive to reinforce copyright law in order to adjust domestic institution to a global standard. Secondly, according to on-line technology development, be discovered conflicts by copyright law and technology. On-line cultural space have feature of infinite circulation which influence mutually in cultural production, flow, consumption, reproduction. Reinforcing copyright law is shrinking on-line users` participation and free expression. force netizens who use blog, UCC, Cafe etc. to copyright lawsuits. And hold transnational culture interchange. therefore, present copyright law has to improve that balance between public use and protection in copyright law. I hope this comparative research will provide a clue for copyright culture regulation in east-asia.
