법에 투영된 장애인체육 현황 및 변천과정 - 국민체육진흥법·시행령·시행규칙을 중심으로 - = The Present State and of Changing Process of Disabled Sports in Laws - Focusing on the National Sports Promotion Act -

The purpose of this study was set up to infer the improvements for the future projected on to the national sports promotion act Disabled sports-related laws and the transition to disabled sports and proper legal system. For this purpose, disabled athletic disabled sports and related laws are sought investigated. Thoroughly analyzed policy measures of the national sports promotion act of Korea. Disabled sports and national sports promotion act has been revised since 2005, recognizes the right of countries should actively support. Disabled sports and the relevant provisions of the enforcement decree of the Korea national sports promotion act, look at the status of enforcement of rules and revision of the future disabled sports and the national sports promotion act futuristic policy can help to provide basic data analysis the results of this study are as follows. First, the national sports promotion act, enacted in 1962, is Korea athletic regulations and requirements, but overall, the first time in 2005. Disabled sports promotion act enacted has been revised in accordance with the based development is made. Second, the law disabled sports promotion act in the national sports promotion act in the national sports promotion act are shown under article 2, article 13, article 14, article 18, article 22, article 34, article 40, article 41, article 42, the enforcement decree are shown under the article 2, article 15, article 17, article 41. However enforce the rules set forth in article 25 of the full legal provisions was incomplete now. Third, of disabled athletic matters concerning the revision of the national sports promotion act conditions by disability type, functional requirements change according to age, because it is necessary to sufficiently consider the disabled sports. 국문 초록 (Abstract)

본 연구는 국민체육진흥법에 투영된 장애인체육관련 법률 및 변천과정을 탐색하고 향후 장애인체육의 올바른 법 제도 개선사항을 추론하고자 수행되었다. 이를 위해 우리나라의 국민체육진흥법 중 장애인체육관련 법률 현황을 면밀히 분석해 보고 장애인체육의 활성화 정책방안을 모색해 보고자 하였다. 장애인체육은 2005년을 기점으로 국민체육진흥법이 개정되어 국가가 적극 지원해야할 권리를 인정하고 있다. 이를 바탕으로 우리나라 국민체육진흥법, 시행령, 시행규칙의 제·개정 현황을 살펴보고 그 중 장애인체육관련 조항을 분석하였다. 본 연구의 목적은 향후 장애인체육의 국민체육진흥법 내 미래지향적인 정책적 도움을 줄 수 있는 기초자료를 제공하는 것에 있다. 이에 따른 연구의 결과는 다음과 같다.
첫째, 국민체육진흥법은 1962년 제정되어 우리나라 체육전반 사항을 규정하고 있으나 장애인체육법률은 2005년 처음으로 개정되어 법률 근거에 따라 발전이 이루어지고 있다. 둘째, 국민체육진흥법 내 장애인체육에 관한 법률은 제2조, 제13조, 제14조, 제18조, 제22조, 제34조, 제40조, 제41조, 제42조, 제42조에 나타나 있으며, 시행령은 제2조, 제15조, 제17조, 제41조에 나타나 있다. 또한 시행규칙에는 제25조에 규정되어 있으나 현재로써는 전체 법률 조항 중 미비한 것으로 나타났다. 셋째, 장애인체육은 장애유형별, 기능별, 연령별에 따른 변화요건이 많으므로 국민체육진흥법에 관한 사항 개정 시 장애인체육의 여건을 충분히 고려할 필요가 있다. 넷째, 장애인체육의 지원체계를 구체화하기 위하여 국민체육진흥법의 법적 조항을 세부화하여 장애인체육을 적용시킬 필요가 있다.
