This thesis examined the legal issues to be considered in management of science and technology performance. First of all, this thesis examined the factors to be considered in determining whether the performance of science and technology would be used as trade secretes or will be made as rights through patent application; discussed the strengths and weaknesses of trade secrete protection system and patent system; and discussed the employee`s invention system regarding whom the rights of science and technology performance belongs to. In addition, with regard to security management of science and technology performance, this thesis examined domestic laws on regulation of technology outflow as well as severity of technology outflow by Patent Troll. In the end, this thesis discussed the plans for protection of science and technology performance by DRM technology.
