지방출자.출연기관 설립타당성 조사제도의 합리적 개선방안 = Rationalization of the Feasibility Study System for the Establishment of Local Investing and Funding affiliates

국문 초록 (Abstract)

본 연구는 ｢지출법｣을 통해 법제화된 지방출자･출연기관 설립타당성 조사제도의 실태를 살펴보고, 이를 바탕으로 지방출자･출연기관 설립타당성 조사제도의 문제점과 개선방안을 탐색하였다. 지방출자･출연기관 설립타당성 조사제도의 주요내용을 분석한 결과, 현행 설립타당성 조사제도는 적용대상의 포괄성과 실효성, 공공기관을 전문기관으로 선정･지정한데 따르는 조사수요의 집중과 관료적 행태, 타당성 검토기준에 내포되어 있는 불명확성과 획일성, 타당성 여부의 판정기준과 방법의 미흡성 등의 문제점을 내포하고 있는 것으로 밝혀졌다. 이런 문제점을 개선하기 위해 본 연구는 설립타당성 조사대상의 예외조항 도입, 전문기관의 역량 강화와 유인적합성 제고, 조직특성과 사업별 특성을 고려한 타당성 검토기준의 재설계, 타당성 여부의 판정기준과 판정방법의 명확화 등의 개선방안을 제시하였다. 지방출자･출연기관의 경우에는 광역자치단체와 기초자치단체별로 타당성 검토를 위한 전문기관이 다양하게 선정･지정되어 있기 때문에 타당성 검토결과의 일관성과 신뢰성을 확보하는 것이 긴요하다. 이에 설립타당성에 관한 일반지침이나 매뉴얼 등을 작성･배포하여 공통적인 기준이 적용될 수 있도록 함으로써 전문기관에 의한 임의적인 해석의 가능성을 최소화하고 타당성 조사결과의 객관성과 신뢰성을 제고해야 한다는 점을 강조하였다.

다국어 초록 (Multilingual Abstract)

This study looked at the actual conditions of the feasibility study system for the establishment of local government investment-funding affiliates(LGIFAs) and then explored the problems and recommendations of the feasibility study system. Instead of abolishing the relevant provisions of the Local Public Enterprises Act, the government enacted the Act on the Establishment and Operation of Local Government Investing-Funding Affiliates in September 2014, legislating a feasibility study system for the establishment of LGIFAs. Based on the main contents of the feasibility study system for the establishment of LGIFAs, We pointed out the inclusiveness and effectiveness of the scope, the concentration of the survey demand and bureaucratic behavior of public institutions following the selection and designation of dedicated agency, the uncertainty and uniformity of the feasibility study standards, and the lack of the criteria and methods for determining feasibility as major problems. To improve this, We recommended the introduction of exception clause to the feasibility study subjects, enhancement of competence and incentive compatibility of dedicated agencies, redesign of feasibility study criteria considering organizational and project-specific characteristics, and clarification of feasibility criteria and methods. In the case of local investment and funded affiliates, it is essential to ensure consistency and reliability of the feasibility review because various dedicated agencies are selected and designated for feasibility review by metropolitan and provincial governments. It was emphasized that the objectivity and reliability of results should be enhanced by preparing and distributing general guidelines or manuals on feasibility study so that common standards can be applied, minimizing the possibility of arbitrary interpretation by dedicated agencies.
