공항운영자 보안자회사의 보안검색 실패에 따른 과태료 부과 논쟁

국문 초록 (Abstract)

1년 안에 같은 위반행위 고의, 과실이 없는 보안검색 실패의 경우 과태료 등 처벌 위주의 사후대책 보다는 사전예방에 집중할 수 있도록 공항 보안수준 평가체계 도입을 제안한다. 즉, 공항의 시설 규모에 따른 보안시설ㆍ인력ㆍ장비 수준을 고려하여 평가할 수 있도록 승객 또는 운항횟수 기준으로 공항을 그룹화 하는 것이다. 승객 수 기준 보안실패 발생율ㆍ보안장비 보유율ㆍ고급인력 확보율 등을 상대 평가하여 작은 공항도 공정하게 평가 받는 구조를 마련해야 한다. 이는 항공보안 취약점을 계량화하여 공항별 보안수준을 평가하기 위해 점검항목을 점수화하는 제도이다. 이를 토대로 항공보안 법령 준수를 유도하여 항공보안 증진에 기여하게 될 것이다.

다국어 초록 (Multilingual Abstract)

In order to focus on preventive measures rather than post-measures such as fines for failures in security screening without intent or negligence within a year, we propose the introduction of an airport security level evaluation system. In other words, airports will be grouped based on the number of passengers or the number of flights so that the level of security facilities, personnel, and equipment can be considered and evaluated based on the size of the airport facilities. A structure should be established so that even small airports can be fairly evaluated by relatively evaluating the security failure rate based on the number of passengers, the possession rate of security equipment, and the acquisition rate of high-level personnel. This is a system that scores inspection items to evaluate the security level of each airport by quantifying aviation security vulnerabilities. Based on this, it will induce compliance with aviation security laws and contribute to the enhancement of aviation security.
