반영구화장의 실태조사와 법적제도 정착을 위한 개선방안 연구

국문 초록 (Abstract)

본 연구는 반영구화장의 법적제도 정착을 위한 개선방안에 대한 것들을 연구함에 그 목적이 있다.
여러 나라의 관련 입법례와 규정들을 알아보고 우리나라의 현재 상황에 맞는 법적제도의 방향성을 설문지를 통해 알아보았다
부산 소재 20~50대 남, 여 230명을 대상으로 2017 10.1일부터 2017 11.1일까지 설문조사를 하였고 그중 총 230부중 불성실하게 응답한 29부를 제외한 나머지 총 201부의 자료를 분석에 활용하였다.
본 연구의 결과를 통해 알 수 있는 내용은 반영구 화장에 대한 인식(95%)나 되는 현 실정에 그 알게 된 경로도 주변에 있는 뷰티 샵 을 통해서나(39.3%) 친구를 통해서가(38.7%) 으로 대부분의 사람들이 반영구화장에 대한 내용들을 가까운 지인이나 샵 을 통해 알고 있으며 남녀노소를 불문하고 많은 사람들이 반영구 시술의 경험을 반영구 전문가가하는 샵 을 통해서 이루어지고 있다.
반영구화장 합법화에 대한 생각들은 시술 대상자에서 반영구화장 전문가가 85.1%로 가장 많이 응답하였고 문신사법 통과 시 일반인 시술 가능에 대한 생각에서 가능하다가 87.1%로 가장 많이 응답하였다.
외국의 입법례의 내용 중 문신면허취득시험에 관련된 부분에서 가장 중요하다고 생각되는 부분은 감염관리 등이 51.7%로 가장 많이 응답하였다. 또한 반영구화장 시 중요하게 생각되어지는 부분에서는 시술자의 실력이 53.2%로 가장 많이 응답하였고, 미용인들의 반영구화장시술 합법화에 대한 생각에서는 찬성한다가 72.1%로 가장 많이 응답하였다. 그리고 반영구화장 합법화 시 허용할 수 있는 시술의 범위에서는 모두 허용이 40.8%로 가장 많이 응답하였고, 반영구화장 시술 합법화 시 적당한 방법은 반영구화장 자격증제도를 도입이 42.8%로 가장 많이 응답하였다. 마지막으로 반영구화장시술 합법화 시 시술대상 중 규제대상에서는 특수질병을 가지고 있는 환자가 55.37%로 가장 많이 응답하였다.
그럼으로 이러한 결과들을 바탕으로 우리나라 법적제도 정착 시 필요한 과제부분을 크게 세 가지로 나누어 보았다
첫 번째는 반영구화장의 자격증제도 같은 합리적인 입법안 마련이 필요하다고 본다.
두 번째로는 시술범위나 규제 대상의 명확성도 필요할 것이다.
외국 사례를 보면 유륜 및 생식기 부위는 시술불가라는 항목이 있듯이 정확하게 시술 할 수 있는 범위 와 시술받는 이들의 연령대와 병력도 중요할 것이다. 세 번째로는 보건복지부에서 현재 의료법관련으로 여겨지고 있는 반영구화장에 대한 정확한 규제와 보안이 필요할 것이다.
위생이나, 적절한 장비, 재료와 시술법의 정확한 규정이 뒷받침 되어져야 한다고 생각한다.

이 연구를 토대로 앞으로 많은 반영구 업에 종사하는 사람들이 향후 제대로 된 법적제도의 규제 아래 반영구화장이 미용의 한 분야로써 제대로 된 직업군으로 거듭나기를 바랍니다.

다국어 초록 (Multilingual Abstract)

The object of research is to establish legal system of semipermanent makeup

Fist of all, From October 1st to November 1st, 2017, we have checked the law of various nations and survey to people who live in Pusan 20 to 50 years-old. Also, we discovered people to insincere answer and total number of the person is 29 people out of 230 people. Based on the content, we will signpost suitable for the present situation in our country.

A lot of people (95%) had a positive recognition the semipermanent makeup. Also most people could know the semipermanent makeup through their friend(38.7%) or nearby Beauty shop(39.3%) operated by experts and a lot of people already experienced it in there.

In conclusion, a lot of people have known the makeup through their friend or beauty shop, regardless of age and sex they had experienced it and had a positive recognition.

Many experts(85.1%) of semipermanent makeup agreed that the semipermanent makeup is become legal. In addition, in case of tattoo law, the respondents(87.1%) said, “ordinary people can also the perform procedures.”

Among the relevant laws of the preceding countries (Tattooing license test), Most importantly part in that was hygiene and infection control. Those who agree with it was the highest 51.7 percent.

Not only that, the respondents said, “the most important part of the procedure is that the experts skills(53.2%).”

Moreover, if the semipermanent makeup becomes legal, it have to “all accept(40.8%)” as the range of surgical procedure.

Also, respondents(42.8%) was said “If the semipermanent makeup is legalized, we must bring in the accrediting system.”

Furthermore, they(55.37%) was said if the semipermanent makeup is legalized, it have to regulate people who have special disease

accordingly, in case of applying makeup, the result of a few important things as below are

First, reasonable lawmaking of the semipermanent makeup like accrediting system.

Second, procedure range and perspicuity of regulated subject.

third, necessity need for sanitary regulation and supplementation from current practice by Ministry of Health and Welfare.

As a result, I think that the best important part of three is the above things.

I hope that the experts of corresponding types of business work inside the prescribed laws and regulations to work. As well as I firmly want that the semipermanent makeup is established a beauty business
