해상보안범죄의 처벌 등에 관한 특례법 제정에 관한 연구 = Study on Enactment of Laws on Special Punishment and Procedure for Maritime Security Crimes

다국어 초록 (Multilingual Abstract)

It is very important to keep the safety of maritime routes from piracy or terrorists because of the nature of our country's economy which has high degree of dependence upon foreign trade. Because piracy, armed robbery and maritime terrorism are threats to maritime safety which are violent crime on the national level, they should be comprehensively handled in the category of maritime security crime. The criminal code system regarding maritime security crimes in South Korea should be amended due to the flaw of crime requirement, the needs of the international community and the impropriety controversy regarding criminal investigation procedures. In addition, because the pirates are civilians, the police are in charge of counter-piracy rather than the navy. Thus, we propose the enactment of laws on special cases of criminal punishment and criminal investigation procedures for maritime security crimes, international cooperation and overseas deployment of police officials.

국문 초록 (Abstract)

무역의존도가 높은 우리나라의 경제특성상 해적이나 테러범 등으로부터 해상수송로의 안전을 지켜내는 것은 매우 중요한 일이다. 해적, 해상무장강도, 해상테러행위는 해상의 안전을 위협하는 초국가적 폭력범죄라는 공통점을 가지고 있기 때문에, 해상보안범죄라는 범주 속에서 포괄적으로 취급할 필요가 있다. 해상보안범죄에 대한 우리나라의 형사법 체계는 범죄요건의 흠결, 국제사회의 요구, 수사절차상의 위법성 논란 등으로 개정되어야 한다. 또한 해적은 민간인이기 때문에 해적범죄의 수사는 군인이 아닌 경찰관이 담당하여야 한다. 그러므로 해상보안범죄에 관한 형사처벌, 수사절차, 국제협력, 해외파견 함정에 경찰관 승선 등을 규정한 특례법을 제정할 것을 제안한다.
