A study of the Tillinghast estimated that civil liability system costs of the United States were $160 billion in 1995, about 2.3 percent of the gross domestic product. Such numbers help explain why there has been heated debate regarding how to reduce civil liability costs, both in court awards and legal expense. In the late 1980s, shortly after 「the liability insurance crisis」happened during the 1984-1986, the debate has been focused on tort reform proposals expected to reduce the frequency and severity of liability costs both in judgments and litigation expenses.
It this study, 「the liability insurance crisis」during the 1984-1986 which was an main cause of the unavailability and unaffordability of liability insurance, and let to the tort reform activities, is analyzed. In addition, the main 5 tort reform measures which have been passed in the late 1980s and in 1990s are presented and pros and cons of these measures are evaluated. This study will help understand tort reform activities in the U.S.A. and can be used for future enactment or modification of tort reform measures.
