법질서의 통일성 확보를 위한 야간 옥외집회·시위의 금지시간 = Prohibited Time for Outdoor Assembly and Demonstration in the Night to Ensure the Unity of Legal Order

국문 초록 (Abstract)

야간에 옥외집회‧시위를 금지하는 법 조항에 대해 헌법재판소가 헌법불합치 결정을 내린 이후 오랜 시간 입법 공백의 상태가 이어지고 있다. 집회의 주최자 및 참여자의 집회의 자유와 일반 시민의 권리 사이에서 합의점을 찾지 못한 채 입법이 추진되었다가 무산되는 일이 반복되는 것이다. 이러한 상황에서 정치적 합의 가능성을 높이는 개정안을 마련하는 것이 중요하다.
본 논문은 시간적 제한에 관한 입법기준으로 법질서의 통일성에 주목하여, 법체계 전체적인 관점에서 합의 가능한 입법방안을 도출하고 있다. 이를 위하여 먼저 24시를 기준으로 야간과 심야를 구분하는 헌법재판소의 판단을 비판하고, 현행법상 야간과 심야의 시간적 기준에 관한 규정들의 유형과 특징을 분석하여 헌법재판소의 판단이 타당성을 확보하고 있는지 확인한다. 그리고 시간적 제한에 관한 입법원칙으로서 법질서의 통일성의 개념과 내용 및 구조를 논의하고, 법질서의 통일성을 확보할 수 있는 옥외집회·시위의 금지시간에 대하여 3단계에 걸쳐 검토한다.

There has been a legislative vacuum for a long time since the Constitutional Court ruled that the provision of prohibiting outdoor assembly and demonstration in the night was unconstitutional. Legislation is repeatedly promoted and failed without reaching a consensus between the freedom of assembly of the organizers and participants and the rights to rest of ordinary citizens. In this situation, it is important to come up with amendment that increase the possibility of political consensus.
This paper focuses on the unity of legal order as a legislative standard for time limit, and derives the legislation that can be agreed upon from the perspective of the legal system as a whole. To this end, it first criticizes the Constitutional Court's judgment to distinguish between night and late-night based on 24:00, and analyzes the types and characteristics of regulations related to time standards in night and late-night under the current law to confirm whether the Constitutional Court's judgment is valid. It also discusses the concept, content, and structure of the unity of legal order as a legislative principle for time limit and reviews the prohibition time of outdoor assembly and demonstration that can ensure the unity of legal order in three stages.
