環境汚染淨化費用에 대한 基金法導入에 관한 硏究 = A study on the introduction of fund law for pollution purification expenses

다국어 초록 (Multilingual Abstract)

Nowadays, the harmful pollutants have contaminated natural environments, as such air, water, soil or sea. Environmental pollution commonly occurs in a production process of an enterprise. When natural environments are polluted by contaminants, a polluter should purify them. The responsibility of pollution purification expenses should be burdened to the enterprises or the polluter which have caused environmental pollution.
But when they are brought to ruin and cannot be searched, it is difficult to determine the polluter under those circumstances. We therefore need a new policy for the problem of a cleanup cost. There are an environmental tax, a cleanup fund as the proper ways. The introduction of an environmental tax have a variety of the point at issue in Korea. Because an environmental tax is able to have an unsuitable influence to economy.
The liability of purification cost is based on the polluter pay principal in many countries. In America, the Superfund law prescribes the control of hazardous waste and a measure of finances. In netherlands, parhcularly, Soil Protection Act includes the liability of cleanup by a polluter, owner or operator of contaminated site strict liability in the responsibility of reparation.
The establishment of the fund is required by a nation and-municipal in the case of obscurity, or insolvency of responsible parhes in the pollution purification. The system of fund for a cleanup cost can be one of the valuable policies in the prevention of pollution and the protection of environment.
