For the past half century, the ROK-U.S. military alliance played an important role in ensuring peace and stability on the Korean Peninsula. But the alliance is already going through a substantial transformation. In this paper I analysed the system and problems in the ROK-U.S. Mutual Defense Treaty, power of operational control in wartime the ROK-U.S. Security Consultative Meeting, and other issues related to the relocation of the U.S. forces in Korea from the constitutional perspective. The U.S. Foces in Korea is being relocated to increase the strategic flexibility of the forces in the East Asian areas. But the relocation changes the character of the ROK-U.S. military alliance without the revision of the Mutual Defense Treaty. The USFK does not staion in Korea to deter against the North Korean threats, but against the threat from China. It is needed the approval of the parliament to change the treaty, but the Korean government agreed to the strategic flexibility without the approval of the parliament. The power of operational control in wartime constitutes the core of the sovereignty, but the power was transferred to the U.S. It`s the time to seriously think about the future of ROK-U.S. alliance.
