스마트공항의 인공지능기술 활용에 관한 법적 쟁점-출입국시스템고도화와 개인정보보호를 중심으로- = Legal issues regarding the use of Artificial Intelligence technology in Smart Airports -Focusing on Immigration system advancement and Protection Personal Information-

국문 초록 (Abstract)

본 연구는 최근 몇 년 사이에 인공지능기술이 급속도로 발전함으로써 발생한, 항공분야 특히 스마트공항을 추진하고 있는 상황에서 발생할 수 있는 생체정보 등 개인정보보호에 관한 문제를 다루었다. 2022년 말 등장한 chatGpt라는 생성형 AI로 인해 인공지능의 사회적 영향력이 무척 커졌다. 따라서 인공지능과 관련한 법적마련이 시급한 상황에서, 인공지능관련 법안은 21대 국회에서부터 발의된 법안들은 21대 국회 임기만료로 폐기되었다.
이어 22대 국회에서 발의된 법안들은 아직 검토중이다. 이러한 와중에 유럽연(EU)은｢인공지능법｣을 2024년 6월 최종통과 시킴으로써, 세계 최초 인공지능법을 성문법화 하였다. 인공지능과 관련한 규범의 기준을 참고해 볼 수 있는 기회이면서, 관련 법률의 입법이 시급함을 동시에 상기시켜주는 사건이다.
한국은 몇 해 전 법무부는 출입국 심사를 고도화하기 위해 인공지능기술에 활용하고자 법무부가 보유하고 있는 내국인과 외국인의 생체정보를 민간업체에게 넘긴 사건이 개인정보보호위반과 헌법상 기본권침해의 측면에서 법적 논란을 가져왔다. 인공지능기술 관련 법률 마련이 시급한 때이기도 함과 동시에 문제점으로 지적받는 개인정보보호의 문제, 특히 이러한 생체정보를 수집할 수 있는 국가 기관의 그 개인정보처리의 책임 문제를 해결해야 하는 문제도 동시에 상존하고 있다.
따라서 인공지능관련 기본법이 마련될 수 있도록 제언함과 동시에, 인공지능법률이 제정되기 전까지 그러한 기술의 활용이나 개인의 정보를 그러한 기술에 이용하는 것에 대한 법적 미비는 결국 개별법인 ｢출입국관리법｣에서 개정을 통하여 법의 사각지대를 해소할 수 밖에 없음을 강조하였다. 또에 이에 따른 출입국관리법상 수집하게 되는 생체정보등을 초함한 개인정보의 인공지능기술등의 활용에 있어 개인정보의 주체에게 사전에 동의를 받을 수 있도록 하는 개선의견을 제시하였다.

Artificial intelligence technology has developed rapidly in recent years. In particular, the social influence of artificial intelligence has grown significantly due to generative AI called chatGpt, which appeared in late 2022. Therefore, in a situation where legal provisions related to artificial intelligence are urgently needed, the bills related to artificial intelligence proposed from the 21st National Assembly were discarded upon expiration of the term of the National Assembly, and the bills proposed from the 22nd National Assembly are still under review. Meanwhile, the EU finally passed the Artificial Intelligence Act in June 2024. It is an opportunity to refer to regulatory standards related to artificial intelligence, and it is an incident that simultaneously reminds us of the urgent need to enact related laws.
In Korea, a few years ago, the Ministry of Justice was pointed out that it was a violation of personal information protection and a violation of fundamental rights under the Constitution when it handed over biometric information of Koreans and foreigners held by the Ministry of Justice to a private company in order to use it in artificial intelligence technology to improve immigration screening. At the same time, it is an urgent time to prepare laws related to artificial intelligence technology, and at the same time, there is a need to solve the problem of personal information protection, which has been pointed out as a problem, especially the responsibility of state agencies that can collect such biometric information for processing personal information. there is.
Therefore, until the artificial intelligence-related law is established, the legal inadequacy regarding the use of such technology or personal information for such technology is ultimately necessitated by establishing related regulations in the Immigration Control Act, an individual corporation, to resolve blind spots in the law. Opinions for improvement were presented in this regard.
