한 · 중 FTA의 상호인정협정 활성화방안에 관한 연구

A slowdown of the world economy since 2008 has increased non-tariff barriers and TBT (Technical Barriers to Trade) which is a new protective trade means. The initialing of the FTA negotiation with China for improvement of the competitiveness in exports is not an exception
TBT agreement includes all obstacles rooted in different criteria of technical regulation, standards, certification, and conformity assessment procedures between countries.
The number of cases reported to WTO in 2015 of TBT of China are 1,016, which is ranked in second place, following the USA. Since 2003, China is requiring the CCC (China Compulsory Certificate) mark to be put on more than 172 items. According to the CCC regulation which provides safety and quality certification system, any item distributed in China or exported to China, including electric, electronic devices and automobile items, need to acquire the CCC mark.
The need of FTA of certification and MRA (Mutual Recognition Agreements) of Technical Barriers are being raised in order to settle the TBT. A number of countries have established certification process according to international standards, and are promoting an expansion of international trade through it.
However, these regulations are being implemented while ignoring WTO/TBT agreement’s National Treatment Principle and Non-discrimination Principle.
Accordingly, this study suggests WTO’s recommended MRA of Cross specifying system in order to perform Korea-China FTA/TBT agreement smoothly. Cross specifying system allows the exporting country to select the conformity assessment institution which can satisfy the country’s technical barriers and conformity assessment procedures. Both exporting and importing countries may benefit in time and cost reduction.
