권력분립 원리, 무엇을 가르칠 것인가?: 2015 개정 고등학교 「정치와 법」 교육과정과 교과서의 문제점과 개선방안을 중심으로 = Principle of Separation of Powers, What Should Be Taught?

국문 초록 (Abstract)

이 글은 학생들에게 권력분립 원리를 현대적 상황에 충실하게 가르치기 위해 교육과정 내용과 교과서 서술을 일부 수정하자고 제안하는 것을 목적으로 한다. 이러한 목적을 달성하기 위하여 우선 권력분립 원리의 개념과 고전적 권력분립론, 현대 입헌민주국가에서 고전적 권력분립이 가지는 한계와 이를 보완하기 위해 새롭게 주장되는 현대적 권력분립론을 고찰하였다. 그리고 이와 같은 이론적 논의를 바탕으로 분석 준거를 도출하여 고등학교 「정치와 법」 교육과정과 5종 교과서에서 권력분립 원리를 어떻게 서술하고 있는지 구체적으로 살펴보고, 이와 같은 내용과 설명이 가지는 문제점과 개선 방안을 제시하였다. 마지막으로 이상의 논의를 정리하며 글을 맺었다. 논의 결론은 다음과 같다. 첫째, 교육과정에서 권력분립 원리를 명시하고 있고 모든 교과서에서 권력분립 원리를 제시하였지만 대부분 교과서에서 권력분립 원리의 정의를 명시적으로 서술하지 않았다. 둘째, 고전적 권력분립론은 충실하게 구현하고 있었다. 셋째, 현대적 권력분립론은 충실하게 구현되어 있지 않았다. 이에 대한 구체적인 분석을 바탕으로 교육과정 내용과 교과서 서술 일부 개선을 제안하였다.

다국어 초록 (Multilingual Abstract)

This article aims to propose some modifications to the curriculum content and textbook narrative in order to teach the principle of separation of powers in a way that is faithful to the modern context. To achieve this goal, first, this article examines the concept of the principle of separation of powers, the classical theory of separation of powers, the limitations of the classical theory of separation of powers in modern constitutional democracies, and the modern theory of separation of powers that is newly advocated to compensate for these limitations. Based on these theoretical discussions, we derived an analytical framework to examine how the principle of separation of powers is described in high school “Politics and Law” curricula and textbooks, and suggested problems and ways to improve them. Finally, this article concludes by summarizing the above discussion. The conclusions of the discussion are as follows: First, although the curriculum explicitly stated the principle of separation of powers and all textbooks presented the principle of separation of powers, most textbooks did not explicitly state the definition of the principle of separation of powers. Second, the classical theory of separation of powers was faithfully implemented. Third, the modern theory of separation of powers was not faithfully implemented. Based on the detailed analysis, I proposed some improvements to the curriculum content and textbook descriptions.
