신국제사법의 해사 국제재판관할 규정에 관한 소고 - 영미법상 해사대물소송을 중심으로 - = A Study on the International Adjudicatory Jurisdiction in Maritime Claims under the new Private International Law of Korea – focusing on Admiralty Claim in Rem of Common Laws

The fully amended Private International Law of Korea(“KPIL”) has come into force since 7. 5. 2022. Under the amendment, the Ship Arrest Jurisdiction, allowing the courts of the country in which the arrest was made to have jurisdiction to determine the merits of the cases, is introduced to the international maritime cases under courts of Korea. As the Ship Arrest Jurisdiction is considered as the key element of maritime claim in rem of common laws, it is possible to implement maritime litigation similar to claim in rem in Korea, even though claim in rem is not legally recognized under laws of Korea. Thus, there is a great need to obtain implications by studying on the maritime claim in rem system under common laws.
In this paper, we first examine the specific aspects of the maritime claim in rem of United Kingdom and United States. By looking into the specific procedures of maritime claim in rem, including international adjudicatory jurisdiction of maritime cases, we can compare maritime litigation procedure of Korea to that of common law countries. We also review the ship arrest jurisdiction provisions of the 1952, 1999 arrest convention and compare them to the ship arrest procedures of common laws and Korea. Through those reviews, we can derive implications on proper interpretation of the newly introduced Ship Arrest Convention provision of KPIL. Along with the necessity of establishing the admiralty court, which is currently actively being discussed in Korea, we also need to review the meaning of introduction of the Ship Arrest Jurisdiction and future tasks on establishing the admiralty court of Korea.

국문 초록 (Abstract)

신국제사법이 법률 제18670호로 전부 개정되어 2022. 7. 5.부터 시행되었다. 선박에 대한 가압류·압류를 통해 본안 관할권을 창설하는 소위 “선박 가압류관할” 제도가 도입되었다. 이는 선박 등 물건을 대상으로 소를 제기하는 영미법상 해사대물소송(admiralty claim in rem) 제도에 있어서 핵심적인 요소이다. 선박 가압류관할 제도의 도입을 통해 우리나라에서도 대물소송과 유사하게 해사소송 제도를 운용하는 것이 가능하게 되었다고 평가할 수 있는바, 영미법상 해사대물소송 제도의 구체적인 모습을 살펴봄으로써 우리 신국제사법의 해사사건에 관한 국제재판관할 규정의 바람직한 해석 및 개선 방안 등을 고민해보고자 한다.
본고에서는 먼저 영미법상 해사대물소송(영국, 미국)의 구체적인 모습을 살펴본다. 국제재판관할을 포함한 구체적인 절차를 상세히 살펴봄으로써 영국과 미국에서는 해사대물소송이 어떻게 구현·운영되고 있는지 검토한다. 이러한 검토를 바탕으로 우리 신국제사법의 해사사건 국제재판관할을 분석하고, 특히 선박 가압류관할 규정의 해석이나 개선 방안에 대해 집중적으로 검토한다. 다음으로 현재 법원 내외부에서 활발히 논의되고 있는 전문법원인 해사법원 설립의 필요성과 함께, 해사법원이 도입되는 경우 신국제사법의 해사사건 국제재판관할 규정이 가지는 의미와 향후 과제 등에 대해 검토한다.
