캄보디아의 토지소유 법제에 관한 연구 = A Study on the Landholding Legislation in Cambodia

국문 초록 (Abstract)

캄보디아는 1991년 내전이 공식적으로 종결된 이후, 1993년 캄보디아왕국 건국헌법(Constitution of the Kingdom of Cambodia)의 제정으로 입헌 군주제의 정치체제를 채택하여 정국을 점차 안정화시키게 되었고, 아울러 시장경제체제를 채택함으로써 사회주의 국가의 모습에서 벗어나 자본주의 국가로 체제를 전환하게 되었다. 이에 따라 1990년대에 시작된 외국과 국제기구들의 지속적인 노력들은 캄보디아에 토지소유권에 관한 민법, 토지법, 구분소유건물의 전유부분의 소유권을 외국인에게 부여하는 법률 등에 있어 외국법제의 도입을 이끌어내게 되었다. 그러나 많은 법률들이 국내 법조인들의 의미 있는 참여 또는 다른 공여국과의 협력 없이 특정 지원자의 인식에 기반을 두었다. 이로 인해 법을 조화시키려는 최근의 노력에도 불구하고, 법적 불명확성이 지속되고 있다. 따라서 본 논문에서는 캄보디아의 토지 관련 법제에 대한 고찰을 주된 목적으로 하여 우리나라와 캄보디아의 법제교류 및 협력강화에 이바지 할 수 있는 토대를 마련하고자 한다.

In Cambodia, after the civil war was officially terminated in 1991, the Constitution of the Kingdom of Cambodia was adopted in 1993 and the constitutional monarchy system was adopted to gradually stabilize the country. In addition, By doing so, it was transformed from a socialist state to a capitalist state. As a result, the ongoing efforts of foreign and international organizations in the 1990`s led to the introduction of foreign legal systems in the Civil Law, Land Law and Law on Providing Ownership Rights in Private Areas of Co-Owned Buildings to Foreigners on land ownership in Cambodia. However, many of the laws were based on the perceptions of the particular foreign sponsor without meaningful participation by domestic lawyers or cooperation with other donors. As a result, despite recent efforts to reconcile the laws, legal ambiguity persists. Therefore, this paper aims to provide a foundation for contributing to the strengthening of legal system exchange and cooperation between Korea and Cambodia, with the main purpose of reviewing land related legislation in Cambodia.
