당사자 소송의 현황 및 그 평가 = Party Litigation in Korea and its Evaluation

국문 초록 (Abstract)

행정소송법상의 당사자소송은 1980년대까지는 거의 사용되지 못하였다. 그리하여 일찍이 당사자 소송의 활성화 여부와 관련하여 무용론과 활성화론 사이의 견해 대립이 있어 왔다. 그러나 그러한 논의와는 별개로 당사자 소송은 법원에서 조금씩 그 영역을 확장하기 시작하였다. 민사소송과의 관계 측면에서 볼 때 당사자소송을 활성화하여야 하는지 여부에 대한 비판적 견해는 행정법원을 신설하기 전까지는 의미가 있을 수 있었다. 그러나 행정법원이 신설되어 있고, 그곳에 공적 법률관계를 주로 다루는 법관들이 모여 있는 이상, 그들로 하여금 사건을 담당하도록 함으로써 법원 입장에서의 효율성을 제고할 수 있다는 점 및 그 과정에서 축적된 이익형량 경험을 통하여 공익까지 고려한 공정한 판단을 기대하여 볼 가능성은 얼마든지 있다. 그러한 측면에서 당사자소송을 활성화할 필요성은 인정될 수 있다 하겠다. 현재까지의 대부분의 당사자소송은 이런 측면에서 존재할 수 있었던 것들이었다. 항고소송과의 관계에서 볼 때 수차에 걸친 행정소송법 개정 시도가 무위로 돌아간 지금 해석론으로라도 효율적인 권리구제를 하고자 하는 시도에서 당사자소송을 활용하자는 견해가 대두되고 있다. 현행법이나 판례가 인정하고 있는 주관적 권리의 범위가 좁기는 하지만, 그러한 한도 내에서라도 효율적인 권리구제를 위하여 당사자소송을 적극활용하여야 할 필요성은 부인하기 어렵다.

다국어 초록 (Multilingual Abstract)

When it comes to use of party litigation, some say 1)administrative agencies are allowed to intervene litigations, 2) records of administrative adjudication are ordered to be submitted, and 3) exceptional rules are applied for consolidated cases. However, these arguments are not enough to support that a party litigation of the Administrative law should replace civil actions which have been generally depended on. When civil cases are redirected to party litigations, they would be reviewed by not civil court but administrative courts. This is true to increase efficiencies of court procedures, but party litigation hardly outweighs civil action since Korea s Supreme Court limitedly allows ex office trial examination for fairness. Some argue that a party litigation helps to consider public interests more than a civil action. In reality, Korea already established administrative courts, having administrative judges with a high level of understanding public law. And then they could not help but making more reasonable decisions. Administrative judges in the administrative courts could help achieve efficiencies of court procedures and fair judgements, but this does not that party litigation outweigh civil actions. Party litigation itself does not guarantee that public interests are considered more carefully. Administrative judges in the administrative courts have high understanding of public law through their careers and they could make better decisions considering public interests. Therefore, Korea’s legal system having administrative courts strongly support applicability of party litigation in Korea. Administrative litigations in Korea have depended on only subjective litigations which require damages to specific, direct and personal interests. These subjective litigations face limits of relief of rights, and party litigations could help these limits. Party litigations are expected to play in important role of completing limits of Korea’s administrative litigations.
