EU의 테러리즘 규제에 관한 법적 검토

국문 초록 (Abstract)

2001년 9·11 사건 이후 테러리즘은 국제평화와 안전을 위협하는 요소로 부각되었고, EU 내에서도 역내 단일생활권에 대한 안전을 위협하는 요소가 되었다. 그런데 더욱 복잡한 문제는 테러리즘 사건에 대한 정치적·종교적·이념적인 다의적 해석이 가능할 뿐만 아니라 민족자결권·인권 침해의 우려가 제기되고 있다는 점이다. 그러나 EU는 테러리즘규제 조치의 한계 또는 비판이 제기될 가능성이 있음에도 불구하고, 역내 "사람의 자유이동"(인적 이동)의 보장으로 인한 단일생활권역의 안전을 확보하여 무고한 인명의 희생을 방지하고자 기본조약상 테러리즘에 대한 규제의 근거를 마련함과 아울러 이사회와 유럽의회 및 EU집행위원회를 통한 이차 입법행위를 통해 "대테러리즘"에 대한 골격결정을 채택하여 회원국들이 테러리즘을 규제하도록 의무화하였으며, 이러한 테러리즘의 규제를 보조하기 위해 "유럽체포영장"의 발부에 관한 골격결정을 채택하여 유로폴의 지원 서비스를 받아 테러리즘 규제에 대한 실효성을 강화하고, 또한 유로저스트와 같은 EU사법부를 통해 테러리즘 등 중대범죄를 규율하고 있다. 그리고 EU는 테러리즘 관련 자산통제, 회원국들 법 집행기관 간의 정보 교환 및 협력, 민간 항공기·선박 및 항만시설의 안전을 확보하는 조치를 취하고 있다. 결국 테러리즘에 관한 EU의 법적 규제는 다음과 같이 정리할 수 있다. 첫째, 테러리즘관련 개념정의를 통하여 유럽이라고 하는 지역 국제사회의 공동생활권을 규율하고 있다. 둘째, EU는 회원국들에게 테러리즘 관련 범죄의 처벌을 의무화하고, 유럽체포영장의 상호 인준에 의해 테러리즘에 대한 형사사법공조를 강화하고 있다. 그럼에도 불구하고 테러리 즘에 관한 범인의 형사적 처벌의 권한은 여전히 각 회원국들의 권한이지 EU의 권한은 아니다. 따라서 EU의 테러리즘에 관한 규제는 일반적인 주권국가의 테러리즘 규제와는 달리 회원국들에 의한 테러리즘 규제를 "지원"(정보교환, 수사 조정 또는 조율, 회원국들 간의 협력체제 구축)하는 것에 주안점을 두고 있다. 이 점에 있어서는 EU가 보다 강도 높은 통합을 이루는 경우 EU차원의 집행권확보도 가능할 것이다. 셋째, EU는 테러리즘 관련 범죄의 정도에 따라 일정부분 양형을 규정하고 있어 테러리즘에 대한 효과적인 억제책이 될 수 있을 것이다. 넷째, 국제테러리즘은 국제형사법원의 관할범죄로 규정되지 못하여 계속해서 개별 국가의 국내법 또는 지침에 의해 규율 되고 있으며, 이는 완전한 연방국가가 아닌 EU도 마찬가지라고 할 수 있다. EU도 테러리즘에 대한 수사권이나 체포 권은 유로폴이 아닌 개별회원국들 당국이 관할권을 여전히 행사하고 있다. 이는 유로저스트 등의 역할 강화를 통해 보완될 수 있을 것이다. 다섯째, EU는 테러리즘 관련 자산을 통제하고, 효과적인 테러행위자의 적발 및 테러행위의 억제를 위하여 회원국들 법 집행기관 간의 테러범죄에 관한 정보 교환 및 협력을 도모하며, 민간 항공기나 선박 및 항만시설의 안전을 확보하는 등 다각도로 역내 안전을 위해 노력하고 있다. 이러한 점들은 단일 국가가 아닌 지역 국제사회인 EU만이 갖는 특징이라고 할 수 있으며, 이는 보편 국제사회의 초국가적 테러리즘에 대한 예방과 규제에 있어서도 또한 중요한 내용이다.

다국어 초록 (Multilingual Abstract)

Since the attacks of 11 September 2001, combating terrorism has become a real global challenge and one of the main objectives of the European Union. Terrorism kills innocent people. Guaranteeing the security of its citizens is one of the EU`s central priorities. However, in many cases, political, religious and ideological differences in which terrorism takes place is far more complex, and it is far less clear who is in the right and who is in the wrong. The European Commission`s main role in this area is to assist EU Member State authorities in carefully targeted actions and initiatives, primarily within the prevent and protect strands. When necessary, the European Commission also supports EU Member States by approximating the legal framework, in full respect of the subsidiarity and proportionality principles. For example, first, Council Framework Decision 2002/475/JHA, which was amended by Council Framework Decision 2008/919/JHA in 2008, provides a common definition of terrorist and terrorist- linked offences. Despite the cooperation of the Europol and Eurojust, it is important to remember that all operational work is performed by EU State`s law enforcement and intelligence authorities. Second, the European Union has adopted Council Framework Decision 2002/584/JHA, was amended by Council Framework Decision 2009/299/JHA in 2009, on the European arrest warrant and the surrender procedures between Member States. The decision simplifies and speeds up the procedures, given that the whole political and administrative phase is replaced by a judicial mechanism. Third, Directive 2005/60/EC of the European Parliament and of the Council was amended by Directive 2010/78/EU of the European Parliament and of the Council in 2010, aims to prevent the use of the financial system for the purpose of terrorist financing. It applies to financial and credit institutions, as well as to certain legal and natural persons working in the financial sector, including providers of goods(when payments are made in cash in excess of 15000 EUR). These entities and persons have to apply customer due diligence(CDD), taking into account the risk of terrorist financing. National financial intelligence units(FIU) are set up to deal with suspicious transaction reports. Fourth, by means of Council Decision 2005/671/JHA, the European Union reinforces police and judicial cooperation to prevent and combat terrorism more effectively. In particular, it aims to improve the exchanges of all relevant information between the operational services responsible for combating terrorism. As shown above, the EU is working hard on preventing and cracking down on terrorist acts and on protecting infrastructures and citizens. It is also tackling the causes, resources and capacities of terrorism. Coordination between the law enforcement agencies and judicial authorities within the EU and international cooperation are also essential to ensure the effectiveness of combating this transnational phenomenon.
