영국의 공용수용의 실행절차와 권리구제수단에 관한 고찰 = A Study on Execution Procedure and Relief of Rights Of U.K's Compulsory Purchase

This paper describes execution procedure and relief of rights Of U.K’s compulsory purchase such as step by category, legal basis, contents, and main legal issues. The history of the land acquisition has already started since the 15th century in the UK. In 1541, the first law, The Bill for the Conduit at Gloucester, to compulsory purchase was enacted. In 1845 ‘Land Clause Consolidation Act’ enacted and general principles of compulsory purchase has established. Even then, a variety of compulsory purchase act was enacted. Through the several revision, laws was developed very systematic and Carefully. And the theories about the land acquisition caused by compulsory purchase, were development. Therefore in U.K, the legal disputes of compulsory purchase and compensation have been solve reasonably. On the contrary we face with a new problem about compulsory purchase and compensation such as Urban renewal. UK already has set up legal and institutional devices by experience. Therefore, we need to study about the UK’s compulsory purchase system. In comparing the legal dimension, research on UK’ law is not much until now. especially this paper focuses on the maintenance of balance between the efficiency of public service and relief of rights. And this paper is described how to resolve legal disputes related to compulsory purchase and compensation. Through the analysis on legal systhem, this paper offer improving our current compulsory purchase system.
