소유권의 본질과 史的 기원 ―로마의 초기 역사를 예로 하여― = The Essence and the historical origins of ownership ―With the examples from the early history of Rome―

다국어 초록 (Multilingual Abstract)

The ownership implies the total control over an object on legal basis. The consequences resulting from the so-called neolithic revolution defined also the order, form and rituals of land possession according to the augural religion in early Italy. Furthermore in the history of Roman synoecism, the amalgamation of villages into cities and the proprietal structure shaped by the augural religion the concept of ‘garden’(which is not decorative as is usual today) is indispensable.
The first view represented by the German historian Theodor Mommsen sees the beginning of land ownership in the garden, not in the farmland. The garden which was decisive for the formation of agricultural order in ancient Rome was inside the inhabited areas. The house and the garden in cities are substantially one integrated entity, which could solely be the object of private ownership. This theory is based on the idea of urban kingdom and derives the rise of ownership from positive dispositions by the kings.
The other argument by the German jurist Okko Behrends regards the rights and power of the Roman augur as caused by the growth of traditional religious rituals transferred through generations. The city, the most sacred place for augural practices according to the conception of early Latins, must be always pure for receiving omens and also giving laws. For this core district its farming peripheries must provide victuals incessantly.
If we take into consideration the characteristics of the pre-urban communities that were in most of the cases agricultural, It would be appropriate to suppose that the rise of law as an organic system of normative institutions is associated with the unity of religion and norm of the ancient Latins. Even the king as author of positive prescriptions and dispositions could not but observe the augural customs, because these are older and firmer than the kingdom itself in the community. Therefore the author views the latter perspective as plausible, while he assumes that the first argument which places emphasis on―mainly royal―positive elements lacks sufficient proofs.

국문 초록 (Abstract)

소유권은 완전한 법적 지배이다. 신석기 혁명으로 발생하게 된 여러 결과들 중 토지질서의 儀式과 형태에 대해서는 로마인이 속하는 라티움 족의 종교와 관습을 고려하여야 한다. 그 맥락 내에서 로마인들의 定住史와 소유권사를 제대로 파악하기 위하여 庭園이 한 역할에 주목하여야 한다.
정원에 관한 첫 번째 견해는 몸젠이 주창하였다. 그에 따르면, 토지의 사소유권은 최초 耕地에 없었다. 토지 소유권의 초기 형성과정에서 오히려 정원이 중요했고, 몸젠은 정원을 정주자들의 주거지에 있었다고 보았다. 주택과 정원을 일체로 보아 ‘정원뙈기’라 불렀고 이것만이 개인의 소유권에 속하였고, 도시 주택은 이렇게 주택과 정원의 일체로 제한되었다고 보았다. 몸젠은 도시왕정이라는 이념의 기초 위에서 왕정의 각종 제정행위에서 소유권이 성립하였다고 본 것이다.
정원에 관한 두 번째 견해는 베렌츠의 것이다. 그는 조점관의 권리를 라티움 족의 일원인 로마에서 대대로 전래되는 鳥占 종교의 의식으로 설명한다. 그런데 조점 종교의 핵심지라 할 수 있는 도시는 징조나 법제정을 위하여 언제나 淨化된 상태에 있어야 했다. 그리하여 정화된 물건은 소유권의 대상이 될 수 없었다. 반면, 이러한 핵심지는 그 핵심지가 생존할 수 있도록 해 주는 경작지를 항상 주변에 두고 있었는데, 그 경작지만이 소유권의 대상이 될 수 있었다는 것이다.
로마는 기본적으로 그 시작이 농경공동체였음을 고려해야 하며, 도시 로마 창건 전부터 전래되던 라티움족의 종교-규범 일체의 상태에서 법의 시초를 찾아야 한다. 그러므로 실정 규정들의 제정자인 왕도 어찌할 수 없었던 확고한 조점 종교적 관행에 기대어 소유권 발생 과정을 설명하는 후자의 견해에 찬동한다.
