한국 관료제와 정치적 중립성의 문제: 쟁점과 현실 = Korean Bureaucracy and the Problem of Political Neutrality: Issues and Reality

국문 초록 (Abstract)

이 연구는 한국에서 최근 중요한 의미를 획득하여 현실적인 논란의 대상이 된 관료제의 정치적 중립성의 문제를 현실적인 쟁점의 제기를 통해 되짚어 보고자 한 시도였다. 애초에 선거에 대한 관료의 개입을 방지하기 위한 방편으로 제도화된 한국의 정치적 중립성은 이후 군사적 권위주의 정권에서 정치 기능을 대신하며 자율성을 누렸던 관료제에 대한 정치적 통제의 필요성 차원에서 규범화되었다. 그러나 최근에는 탄핵을 동반한 정치권력의 교체가 이루어지면서 정치권력의 국가 운영에 대해 관료제가 양심과 영혼에 근거하여 저항하라는 요구가 정치적 중립성으로 윤리적 규범의 의미를 획득하였다. 그러나 상충되는 정치적 중립성의 규범적 요구를 다양한 맥락에서 병립적으로 요구받게 된 한국의 관료제에게 이러한 요구는 현실적인 규범으로서 실질적으로 기능하지 않고 있는 것으로 보인다. 이는 한국의 정치권력 교체가 점진주의적 정책 결정 관행이나 경로의존성 등에 기인하여 실제로는 정책의 구체적인 변화를 수반하지 않는 현실을 반영한 것으로 추정할 수 있다. 이런 상황에서 한국의 관료제는 전문성에 기반한 중립적 역량의 측면에서도, 국민 전체의 이해를 추구하는 과정에서 요구되는 공익 대표성의 측면에서도 정치적 중립성이 실천적 규범으로서 작동하지 않는 것으로 보인다.

This study was an attempt to reflect on the issue of political neutrality of the bureaucracy, which has recently gained significance in Korea and has become the subject of realistic controversy, by raising realistic issues. In the Korean context, political neutrality, which was institutionalized as a way to prevent bureaucratic intervention in elections to protect the basic procedures of democracy. And it was later replaced by the need for political control over the bureaucracy, which enjoyed autonomy while taking over political functions in military authoritarian regimes. However, recently, with the change of political power accompanied by impeachment, the demand for the bureaucracy to resist the unreasonable order by political power based on conscience and soul has acquired the meaning of an ethical norm through political neutrality. However, for the Korean bureaucracy, which is faced with conflicting normative demands for political neutrality in various contexts, these demands do not seem to be functioning as realistic norms in practice. This can be assumed to reflect the reality that the change of political power in Korea does not actually lead to concrete changes in policy due to incremental policy-making practices or path dependence. In this situation, it is difficult to find evidence that allows for a positive evaluation of the Korean bureaucracy both in terms of its neutral capabilities based on expertise required in relation to political neutrality. It is also considered negative in terms of the public interest representation required in the process of pursuing the interests of the entire people.
