      Living with Transitional Justice: Analyzing Victims’ Experiences in State-fabricated Espionage Cases in Retrial Processes*

      Abstract: This study investigates how the concept of transitional justice is concretely experienced and implemented in the lives of victims of fabricated espionage cases. Employing the perspective of ‘Living with Concepts’, the study explores how the core components of transitional justice — ‘perpetrator (s)’, ‘victim (s)’, and ‘resolution’ — are constructed and transformed within victims’ lived experiences. The analysis identifies significant gaps between concepts and experiences, including the ambiguity of perpetrator accountability, temporal limitations placed on victimhood, and the reduction of resolution to procedural terms. These findings underscore the necessity of reconstructing transitional justice within the context of victims’ lives, highlighting the importance of justice rooted in lived realities. Using victims’ oral testimonies, this study examines how they navigated and responded to the limitations of legal and social justice frameworks. By adopting the perspective of ‘Living with Concepts’, it aims to transcend the limitations of conventional approaches to dealing with the past and contribute to the development of victim-centered pathways to achieving justice.
