행정기관의 특별사법경찰권 확장 논의에 대한 연구

국문 초록 (Abstract)

행정사무를 담당하는 행정기관에서 운영하고 있는 특별사법경찰은 각 기관의 고유 행정업무의 효율성 증대를 위해 행정법 내에 사법경찰작용을 담당하는 행정 공무원을 의미한다. 특별사법경찰관리제도의 취지는 소관 행정업무가 고도로 전문 화됨에 따라 일반사법경찰이 수사의 목적을 달성하기 어렵기 때문에 전문성과 긴 급성 등을 근거로 행정공무원에게 사법경찰권을 부여하여 신속하고 원활한 수사 활동을 하기 위함이라고 설명된다. 또한 최근 행정부의 기능과 권한이 강화되고 있음에도 사회의 급속한 분화와 전문화, 다양화에 따라 행정형법상의 범죄도 전문 화와 광역화되고 있는 추세가 되면서 행정법상의 행정범수사에도 효율성을 추구 하면서 전문지식을 갖춘 행정공무원의 수사활동 참여가 증가하고 있다. 우리나라는 17개 정부부처 중 교육부, 외무부, 통일부를 제외한 14개 정부기관 인 법무부, 환경부, 국토교통부, 여성가족부, 해양수산부, 국방부 등과 17개 광역 지방자치단체에서 특별사법경찰제도를 운영하면서 행정에 관한 공법인 행정법을 중심관념으로 하고 있다. 본 논문에서는 전문화 된 행정조직의 행정작용 과정에서 발생되는 범죄 수사업 무를 주로 하는 특별사법경찰 업무가 지속 증가추세에 있는 현황과 문제점 및 실 태분석을 통해 행정기관의 특별사법경찰제도 운영이 정상적 괘도에 안착될 수 있 도록 미래지향적 제언을 전개하고자 한다.

다국어 초록 (Multilingual Abstract)

Special judicial police officers, organized by agencies that are in charge of administrative affairs, are administrative public officials who take the role of judicial police officers in order to boost the efficiency of inherent administrative affairs each agency has. The initial aim of the special judicial police system is to encourage rapid, accurate investigations by granting administrative public officials with the rights as soecial judicial police officers, as they can rapidly and professionally investigate administrative affairs in a world where administrative affairs are becoming more and more diverse and professionalized. Furthermore, the rapid social differentiation and diversification has opened doors for complicated professional crimes under the criminal law. This has resulted in more participation of administrative public officials, who have professional knowledge regarding their inherent field of affairs, in investigations in order to boost efficiency. In South Korea, seventeen regional local governments and fourteen government agencies such as the Ministry of Justice, the Ministry of Environment, the Ministry of Gender Equality and Family, the Ministry of Maritime Affairs and Fisheries, the Ministry of Defense, etc, excluding the Ministry of Education, the Ministry Foreign Affairs, and the Ministry of Unification, are running special judicial police systems based on the administrative law. In this study, we aim to investigate the current state of the special judicial police system and any problems that exist regarding the system, and provide a futuristic suggestion so that the sysrem can safely settle in administrative agencies.
