사이버犯罪 國際共助搜査의 限界와 成功要件

국문 초록 (Abstract)

최근 랜섬웨어, 텔레그램 성착취 등 사이버범죄는 코로나19 상황에도 불구하고 증가하고 있다. 사이버범죄는 국경이 없다는 특성이 있어 여러 국가 간 법집행기관의 국제공조수사가 필수적이다. 그럼에도 불구하고 그 간 외교관계, 각 국가의 형사관할권 등을 이유로 그간 효과적인 국제공조수사는 어려운 실정이었다. 이번 연구는 선행연구와 경찰청 인터폴 국제공조 담당자 인터뷰 등을 통해 공조절차의 복잡성, 공조에 장시간이 소요되는 점, 공조로 확보한 증거의 증거능력 인정 문제, 타국에 공조이행을 담보하기 어렵다는 점 등을 한계점으로 도출했다.
그리고 사이버범죄에 있어 인터폴 국제공조수사 사례를 선정하고 이를 분석하여 이러한 한계점을 극복하는 성공요건을 발굴해 실무적 시사점을 준다. 성공요건으로 신속성, 법적 구속력이 있는 조약 가입, 공조대상국과 높은 신뢰관계, 민간 IT기업 등과의 공조체계 구축 등으로 확인하였다. 이러한 성공요건들이 주는 시사점을 바탕으로 인터폴 국제공조의 법적근거 마련, 공조채널 확대, 공조절차 간소화, 공조 절차 표준화 등 법・제도적 및 정책적인 개선방안을 제시한다.

Recently, Cyber crimes such as ransomware and telegram sexual exploitation have been increasing despite of the COVID-19. Since cybercrime has no borders, international cooperative investigations by law enforcement agencies between countries are essential. Nevertheless, effective international cooperation investigation has been difficult due to diplomatic relations and the criminal jurisdiction of each country.
This study draw the limitations of international cooperative investigation of cyber crimes through previous research and interviews with the National Police Agency's Interpol International Cooperation Officer. It was drawn as a limitation that it is difficult to guarantee.
In addition, Interpol international cooperation investigation cases in cyber crime are selected and analyzed to discover success requirements to overcome these limitations and give practical implications. As the success conditions, it was confirmed that promptness, accession to a legally binding treaty, a high trust relationship with a partner country, and a cooperative system with private IT companies were established.
Based on the implications of these success factors, we propose legal, institutional and policy improvement measures such as preparing a legal assistance for Interpol international cooperation, expanding mutual asi channels, simplifying mutual aid procedures, and standardizing mutual aid procedures.
