지역 환경분쟁 해결을 위한 전문가의 역할과 제언

국문 초록 (Abstract)

1900년 이후 사회적인 갈등과 분쟁 대상 중의 하나가 고도 경제성장의 후유증
으로 인한 지역환경 오염을 둘러싼 내용이다. 현재 환경분쟁을 해결하기 위한 제
도적 수단으로 환경분쟁 조정제도와 법률 소송도 있으나， 대부분의 환경분쟁의 경
우는 관련 당사자 간 또는 행정기관의 조정 아래 해결되고 있다. 이러한 환경분
쟁 해결의 과정에는 사실 확인이나 원인 및 피해 규명 등의 환경문제의 복잡성
때문에 전문가의 개입이 필연적이다. 본 고에서는 환경분쟁의 해결과정에서의 전
문가 참여의 과정과 역할에 대해 대전 3.4산업단지의 생활폐기물 소각장 건설
과 산업단지의 악취 문제를 대상으로 한 지역 주민 운동 사례를 중심으로 기술
평가하였다 또한， 이롤 토대로 앞으로의 바람직한 환경분쟁조정과 전문가 활용
방안을 위한 Govemance제도， 미국의 대체적 분쟁조정제도(ADR)와 Su따fund 등
에 대해 검토하였다. 환경분쟁과 이의 해결 과정에서의 전문가 역할의 당위성과
중요성에도 불구하고 이와 관련 전문가 인력 풀과 체계적인 연구가 부즉한 상태
로 앞으로 다양한 분야에서의 학제적 연구가 절실한 실정이다.

다국어 초록 (Multilingual Abstract)

Local environmental disputes might have been the most important social conflict and
dispute problems in Korea since 1990, which was be mainly due to the adverse effects of
the compressed economic growth and urbanization. There are two major institutional
means ro cope with these disputes in Korea, such as environmental dispute mediation
system and legal lawsuit, but most of the local environmental disputes have been solved
between the interest patties and with the help of administration. 1t has been indispensable
for expert to be involved in the process of solving the dispute in terms of the fact
findings and the confirmation of cause-and-effects of the injuries. In this paper, the
contents and the role of the experts were described and discussed in the process of
resolution for a local environmental dispute case, mainly around a municipal solid waste
incinerator and the odor nuisance by an industrial complex area in Daejeon, Korea. Based
on this case， some institutional systems, such as a governance system, an alternative
dispute resolution system, and a superfund aα were discussed for 야e better utilization of
the experts’ role. Despite the necessity and importance of the experts’ role in the process
of environmental dispute resolution, there have been few studies and educational efforts
until now, which would be promoted in 비 form of the interdisciplinary studies
