개인정보 자율규제영역에서 보장국가로서 국가의 역할에 관한 연구 = A Study on the Role of State as Ensuring State in the area of the Self Regulation on the Personal Information Protection

국문 초록 (Abstract)

이미 우리들에게 잘 알려진 것처럼 정보사회란 정보 그 자체의 중요성이 엄청나게 증대하고 이를 바탕으로 하여 정보의 생산, 유통 및 이용이 기존사회를 새롭게 바꾸는 그러한 사회를 말한다. 결국 정보 그 자체가 가치를 가질뿐더러 또 다른 새로운 가치를 만들어내는 사회, 그래서 정보화 내지는 컴퓨터화를 통하여 근본적인 변화를 받고 있는 사회가 바로 정보사회인 것이다. 그렇다면 이제 우리는 어떠한 정보사회에서 살아야만 하는지를 ‘규범적으로’ 검토해야만 한다. 끊임없이 발달하는 정보통신기술, 인터넷의 등장과 발전 등으로 인하여 과연 하나의 ‘국민국가’를 단위로 하는 ‘헌법’이 살아남을 수 있는지, 살아남는다면 어떠한 과제와 책임을 이행해야만 하는지를 고민해야만 하는 시점에 도달해 있다. 곧 정보사회에서 국민국가가 떠맡아야만 하는 과제목록 및 이에 따르는 이행책임과 이행수단에 초점을 맞추어야만 하는 것이다. 이에 따라서 정보사회에서는 국가의 역할과 기능이 국가의 직접적인 ‘이행책임’ 및 이에 따라 발생하는 ‘결과책임’으로부터 정보질서의 기능과 작용을 가능하게 하는 ‘보장책임’으로 옮겨간다. 이제 국가는 정보사회의 ‘틀(윤곽)’에 관한 조건들을 보장하고, 이 속에서 개인의 자유로운 행위들이 가능하도록 하기 위한 구조들을 설정해야만 하는 것이다. 이와 관련하여 정보사회에서 폭넓게 주장되고 있는 것이 바로 자율규제이다. 자율규제와 국가규제의 장점을 이용하는 동시에 양자의 단점을 보완하는 구상을 통해 양자를 가능한 범위 내에서 결합시키는 것이 필요하다. 이를 위하여 등장하는 것이 바로 ‘규제된 자율규제’이다. 규제된 자율규제란 국가가 정해놓은 틀에 따르는 그리고 그 법적인 기초 위에서 작용하는 자율규제라고 할 수 있다. 개인정보보호에서도 정보사회의 특수성에 대한 존중 및 자유의 진정한 확장이라는 목표는 ‘규제된 자율규제’를 통하여 달성될 수 있을 것이다. 국가는 사회의 자율규제를 신뢰하는 한편 정보자기결정권을 개인이 스스로 보호할 수 있는 가능성을 보장하고 이를 강화하기 위한 기술적, 법적 기반을 마련하여야 한다.

다국어 초록 (Multilingual Abstract)

The Information Society means that in the society the importance of information itself is emphasized and the information production is rapidly increased, so the flow and use of the information could change the society. A form of the development of the Information Society could mention Knowledge Information Society. The Knowledge Information Society connects coherently between the information and knowledge. In the Knowledge Information Society, knowledge is a prime mover for originating value. Our goal for information order should be open, future-oriented and multifarious. In this new society, new responsibility and power for the states are considered. However, states still take a charge for their inherent function in accordance with public law. The character of responsibility is changing from fulfillment to ensuring because it could work better on the state's role and function in the Information Society. Thus states should make the frame of the Information Society. In this frame, individuals can act freely with that well structured outline.
Through the importance of complementary cooperation brought the regulated self-regulation which tunes between self-regulation and government-regulation. The regulated self-regulation acts freely based on the frame made by government. In the point of speciality of the Information Society, regulated self-regulation could attain the goal for new society without a hitch. States should trust self-regulation and prepare technical, legal foundation for ensuring person's self protection of the right to self-determination.
