유럽헌법조약 부결과 유럽통합 심화에의 함의 연구 = The Rejection of the Constitutional Treaty for Europe and its Implications on the Future European Integration

다국어 초록 (Multilingual Abstract)

The negative outcomes of the referendums in France and the Netherlands have halted the ratification of the “Treaty Establishing a Constitution for Europe”. These events illustrate the increasing importance of popular input in ratification process. It is, however, important to recognize that the constitutional treaty represented a landmark development in the process of European integration, seeking to make EU more democratic, transparent and efficient. The constitutional treaty indeed introduced a number of institutional reforms, and it comprised central components for the further development of the EU. Morever, the main features of the constitutional treaty formed part of a ‘multi-level governance’ interwining the national and EU level. Its significant achievements were meant to increase both the efficiency and democracy of the EU institutions, while also preserving a high degree of national participation. Although the constitutional treaty failed to enter into force, it will continue to identify policy options for the future European integration. In this regard, the present ‘period of reflection’ provides an important opportunity to stimulate a wider debate between EU's institutions and citizens on the future development of the EU.

국문 초록 (Abstract)

프랑스와 네덜란드에서의 유럽헌법조약 비준 실패는 유럽통합의 심화와 확대 과정 전반에 걸쳐 큰 영향을 미치고 있다. 유럽헌법조약은 유럽연합 기구 구조 및 제도를 개선하며 민주성과 효율성을 강화할 수 있는 중요한 개혁안을 포함하고 있었다는 점에서 유럽통합의 심화에 크게 기여할 수 있었다. 또한 유럽헌법조약이 비준되었을 경우. 유럽연합에서는 집행위원회 및 유럽의회 등과 같은 초국가적기관의 정책 권한 및 범위가 지속적으로 확장되는 동시에 회원국 정부 역시 정치적 영향력 및 권한을 강화하며 정책과정에의 참여를 확대하는 다층적 거버넌스의 특징을 더욱 강화할 수 있었을 것으로 고려된다. 그러나 유럽헌법조약이 부결됨에 따라 향후로도 개혁에 관한 논의를 지속해야 하는 과제가 여전히 남아 있다. 하지만 유럽헌법조약의 내용과 부결의 경험은 이후 이른바 ‘숙고의 기간’을 거쳐 유럽통합의 방향성을 설정하고 구체적 개혁을 고려하는 과정에서 중요한 선례를 제공함으로써 향후 유럽통합의 심화와 확대를 위한 논의의 초석이 될 것으로 기대된다.
