소상공인 폐업 컨설팅 개선방안 연구 : 폐기물 재활용을 중심으로 = A Study on Improvement Plans for Small Business Closing Consulting:Focusing on Waste Recycling

국문 초록 (Abstract)

폐업한 소상공인을 위한 사회안전망으로 다양한 폐업지원제도가 시행되고 있다. 또한 폐업 과정을 지원하기 위한 폐업 컨설팅이 소상공인시장진흥공단을 통해 일반, 세무, 부동산 분야에 대한 사업정리를 내용으로 운영되고 있다.
소상공인 폐업에서 사업장 철거와 임대공간의 원상복구, 폐업 비용의 절감과 임대업자의 과도한 요구로부터 소상공인을 보호하는 것이 폐업 컨설팅의 주요 내용이었다면, 최근에는 폐업으로 발생하는 폐기물의 분리배출과 재활용에 대한 사회적 책임이 점차 강하게 요구되고 있다.
본 연구는 소상공인 폐업 컨설팅과 관련된 제도와 현황을 조사하고, 폐업 절차와 함께 폐기물 처리에 관한 자료를 분석하여, 소상공인 폐업 컨설팅 개선방안을 도출하였다. 이를 위해, 먼저 소상공인 폐업 현황과 폐업 컨설팅과 관련된 지원제도, 시행 규모와 추진현황에 대해 분석하였으며, 폐업 시 발생 폐기물과 재활용에 대한 학문적 정의와 제도에 대해 정리하였다. 둘째, 국내 폐업 절차와 폐기물 재활용 현황을 조사하고, 해외 폐업 절차와 폐기물 재활용 사례와 비교하여 분석하였다. 셋째, 소상공인 폐업 컨설팅에 있어서 폐기물 재활용 관점의 문제점과 대안을 찾기 위해 전문가를 대상으로 심층 면접 조사를 시행하였다.
연구결과는 소상공인의 폐업 시 폐기물 재활용 분야는 현행 폐업 컨설팅에서는 다루지 않고 있음을 확인하였다. 유럽연합은 사업장 철거 전 자원조사와 폐기물의 분리·수집, 재활용품의 품질관리와 유통, 폐기물 처리까지 철저한 관리체계를 갖추고 있다. 특히, 프랑스는 독립적인 자원조사업체를 통한 사전컨설팅과 객관적인 자원조사가 의무화되어 있는 것이 확인되었다. 또한, 미국의 경우 시장 구매력이 있는 인테리어디자인 회사가 철거공사에서 발생하는 가용자원을 제조업체와의 네트워크를 통해 재생하여 사업장을 새롭게 구성하려는 소비자에게 무상 제공하거나 인센티브로 활용하고 있었다.
전문가 심층 면접조사에서 폐기물 발생과 관련된 소상공인 대상 컨설팅이 폐업 시점에서만 제공되고 있어 충분한 컨설팅 시행이 어렵다는 점이 도출되었다. 두 번째, 폐업 시 발생 폐기물을 적정하게 처리할 경우 오히려 소상공인의 폐기물 처리비용이 상승한다. 세째, 폐기물의 적정 처리와 재활용에 대한 인식이 소상공인, 인테리어업체, 폐기물처리업체까지 모두 부족한 것으로 나타났다. 또한, 소상공인 폐업 컨설팅에 폐기물 재활용을 강화하기 위한 방안도 제시되었다. 폐업 시 폐기물 처리 프로세스 제도화, 평상시 폐기물 재활용에 대한 소상공인 교육과 컨설팅, 폐업 폐기물의 자원 활용 증대를 위한 인센티브 제공과 의무화 등의 개선방안이 도출되었다.
이상의 연구결과를 바탕으로 소상공인 폐업 컨설팅 개선방안을 제안하고, 사업장 자원조사, 시설투자금 회수를 위한 권리금 증빙, 폐자재 판매 및 처리방안, 재사용·재활용 인테리어 계획 등을 폐업 관련 비즈니스 연구과제로 발굴하였다.
본 연구의 내용이 정책적으로 활용된다면, 재기에 어려움을 겪고 있는 폐업 소상공인들에게 도움이 될 뿐만 아니라 정부의 자원순환 정책목표 달성에도 도움이 될 것으로 예상한다.

다국어 초록 (Multilingual Abstract)

Various business closure support systems are being implemented as a social safety net for small business owners who have closed their businesses. In addition, business closure consulting to support the business closure process is being operated through the Small Business Market Promotion Corporation to organize business in the general, tax, and real estate fields.
If the main contents of business closure consulting were the removal of business sites, restoration of rental spaces, reduction of closure costs, and protection of small business owners from excessive demands from small business owners in the event of closure of small businesses, recently, the Responsibilities are increasingly being demanded.
This study investigated the system and current situation related to small business closure consulting and analyzed data on waste treatment along with the business closure procedure to derive an improvement plan for small business closure consulting. To this end, first, the current status of small business closures, support systems related to business closure consulting, implementation scale, and current status were analyzed, and academic definitions and systems for waste and recycling generated at the time of business closure were summarized. Second, the current status of domestic business closure procedures and waste recycling was investigated and analyzed compared to overseas business closure procedures and waste recycling cases. Third, an in-depth interview with experts was conducted to find problems and alternatives from the perspective of waste recycling in consulting on the closure of small businesses.
The result confirmed that the waste recycling sector in the closure of a small business is not covered by the current business closure consulting. The European Union has a comprehensive management system from resource surveys before demolition of business sites, separation and collection of waste, quality control and distribution of recyclables, and waste disposal. In particular, it was confirmed that prior consulting through an independent resource survey company and objective resource survey were mandatory in France. Also, in the case of the United States, an interior design company with market purchasing power regenerated available resources from demolition works through a network with manufacturers and provided them free of charge to consumers or used them as incentives.
In an in-depth interview with experts, it was found that it was difficult to conduct sufficient consulting as consulting for small businesses related to waste generation was provided only at the time of business closure. Second, if the waste generated at the business closure is properly disposed of, the cost of waste treatment for small businesses rises. Third, it was found that small business owners, interior companies, and waste treatment companies all lack awareness of proper waste treatment and recycling. In addition, a plan to strengthen waste recycling was suggested in consulting on the closure of small businesses. Improvement measures such as institutionalizing the waste treatment process at the time of business closure, educating and consulting small business owners on waste recycling in regular times, and providing incentives to increase resource utilization of waste from business closures and making them mandatory were derived.
This study suggests an improvement plan for small business closure consulting. In addition, research projects related to business closure were identified, such as resource investigation of the business site, proof of rights to recover facility investment, sales and disposal of waste materials, and interior planning for reuse and recycling.
If the contents of this study are used in the policy, it is expected that it will be helpful not only to small business owners who are having difficulty recovering after business closure but also to achieve the government's resource circulation policy goal.
