영국 선거법상 허위사실공표와 표현의 자유 = Publication of False Fact and Freedom of Speech under the Representation of the People Act 1983 in the United Kingdom

It is widely accepted that publication of false fact poses a serious threat to the representative democracy. Voters may alternatively choose another candidate instead of a candidate who is otherwise attractive to them if the false fact about the candidate would not be published. Therefore, many countries including the United Kingdom, Canada, New Zealand, the United States of America, Australia as well as Korea passed a statute regulating the act of publishing false fact during an election. The 「Public Official Election Act」 in Korea regulates the three different crimes including the so-called ‘the crime of publication of false fact with the intention of getting elected’ and ‘the crime of publication of false fact with the intention of stopping the candidate from being elected,’ etc.
Meanwhile, Section 106 of the 「Representation of the People Act 1983」 in the United Kingdom provides, in pertinent parts, that “(a) before or during an election, (b) for the purpose of affecting the return of any candidate at the election, makes or publishes any false statement of fact in relation to the candidate’s personal character or conduct shall be guilty of an illegal practice, unless he can show that he had reasonable grounds for believing, and did believe, that statement to be true.” In Watkins v Wollas, the election court decided that Wollas was liable for publishing the false fact, noting that “[i]n our judgment, to say that a person has sought the electoral support of persons who advocate extreme violence, in particular to his political opponent, clearly attacks his personal character or conduct.” Comparing the 「Representation of the People Act 1983」 in the United Kingdom and the 「Public Official Election Act」 in Korea in regard of the crimes of publication of false fact makes us to find some suggestions. First, the Korean Act includes a person who intends to be a candidate in addition to a candidate in Article 250 of the Act. Compared to the British Act, the Korean Act also prohibits any person from publishing any false fact regarding the candidate’s “spouse, lineal ascendants or descendants, or siblings.” Furthermore, the Koran Act is much broader than the Great Britain Act, in that the Korean Act penalizes the act of publishing false fact about the candidate or his spouse, lineal ascendants or descendants, or siblings’ “place of birth, family relations, social status, occupation, career, etc., property, behavior or organization to which he/she belongs of a candidate,” and “about whether the candidate receives support from a specific person or specific organization” unlike the Great Britain Act. The Supreme Court of Korea, where places, in fact, the burden of proof on the criminal defendant, not on a public prosecutor, also causes a chilling effect on free speech. It seems desirable to consider adopting the so-called ‘reasonable grounds defense’ principle from Section 106 of the 「Representation of the People Act 1983」 in the United Kingdom, which allows the defendant to be immune from liability for publishing false fact if the defendant “can show that he had reasonable grounds for believing, and did believe, the statement to be true.”

국문 초록 (Abstract)

선거에서 허위사실이 공표되면 대의민주주의에 큰 위협이 된다. 허위사실로 인해 유권자는 그러한 허위사실이 없었더라면 선택했을 후보자 대신에 다른 후보자를 선택할 수도 있다. 이에 영국, 캐나다, 뉴질랜드, 미국, 호주 등 세계 각국은 물론 우리나라도 선거에서의 허위사실공표를 규제하는 법률을 가지고 있다.
우리 「공직선거법」은 제250조에서 ‘허위사실공표죄’라는 표제 아래 크게 세 가지의 범죄, 즉 당선목적 허위사실공표죄, 낙선목적 허위사실공표죄 및 당내경선관련 허위사실공표죄를 규정하고 있다.
한편 영국의 「국민대표법」 제106조는 “누구든지 자신의 진술이 사실이라고 믿을 만한, 그리고 실제로 사실이라고 믿은 경우로서, 합리적인 근거를 가지고 있었다는 것을 입증할 수 없는 한 (a) 선거 전 또는 선거 중에 (b) 그 선거에서 어떤 후보자의 선출(return)에 영향을 미칠 목적으로 그 후보자의 인격 또는 품행과 관련한 사실에 대하여 허위의 진술을 하거나 공표하면 불법선거의 책임이 있다.”고 규정하고 있다. 영국의 선거법원은 Watkins v Woolas 사건에서 “극단적인 폭력을 옹호하는 사람들의 지지를 얻으려는 사람이라고 말하는 것은 분명히 그 사람의 인격이나 품행에 대한 공격에 해당한다”고 판시하면서 울라스(Wollas)가 허위사실공표의 책임이 있다고 판결하였다.
허위사실공표죄에 관하여 우리의 「공직선거법」과 영국의 「국민대표법」을 비교해 보면 다음과 같은 사실을 알 수 있다. 먼저, 우리법은 대상자에 후보자 이외에 ‘후보자가 되고자 하는 자’도 포함시키고 있고, 후보자에 관한 사실 이외에 후보자의 ‘배우자 또는 직계존비속이나 형제자매에 관한 사실’도 허위사실공표의 대상으로 하고 있다. 또한 우리법은 “출생지․가족관계․신분․직업․경력등․재산․행위․소속단체, 특정인 또는 특정단체로부터의 지지여부 등”에 관한 사항을 규율대상으로 함으로써 영국법에 비해 그 범위가 매우 넓다. 한편 우리 대법원은 낙선목적 허위사실공표의 경우 입증책임을 사실상 피고인에게 전환하고 있어서 언론의 자유를 매우 위축시키고 있다. 반면에 영국의 「국민대표법」은 공표한 사실이 비록 허위일지라도 “자신의 진술이 사실이라고 믿을 만한, 그리고 실제로 사실이라고 믿은 경우로서, 합리적인 근거를 가지고 있었다는 것을 입증”하면 면책될 수 있도록 하고 있다.
