도핑(doping)을 둘러싼 공리주의와 의무론 = A Stydy on Utilitarianism and Deontology surrounding Doping

Doping problem in the sport and sporting ethics must be true unmistakable things to overcoming. So what will be the issue of doping ban any notion of freedom that must be applied if we apply the concept of freedom based on the individual?. According to Mill, the only freedom of the individual is that the pursuit of our own line, as we approach that does not infringe or deprive it of others. But Mill is one of the absolute freedom should be secured for self-regarding action that personal relationship in the midst of the action, and that part which is related to the other-regarding action for society to regulate them. This practice should be prohibited in terms of doping in harm activities that are for others. Utilitarianism sees ethical is that the "greatest happiness of the greatest number". According to the act utilitarianism if any activity is useful in the promotion of happiness, is correct behavior. However, the reason why doping is bad it will reduce the amount of happiness of society as a whole. Brings more happiness by not doing doping and takes less unhappiness so ban doping is definitely right. The central concept in the ethics of Kant's is duty. According to the deontological ethics of Kant, doping is anywhere, anytime with or bad behavior by anyone, the validity of an act does not depending on the result of the action, depending on their own unique nature. Only acts performed in duty is good as moral. Kant is that the only acts done in the duty is good as moral. Thus, doping is bad. Through the utilitarian and deontology of the core system of theory of ethics establish the norms of an moral thinking and ethics for anti-doping. It is the universally valid appropriateness proposition of the sport applied the system of moral rule.

국문 초록 (Abstract)

스포츠에서의 도핑 문제는 가장 극복해야 할 문제임은 틀림없는 사실이다. 따라서 도핑 금지의 문제는 무엇을 해도 개인의 자유라는 개념을 적용한다면 어떤 근거의 자유 개념이 적용되어야 하는 것인가?. Mill에 의하면 개인의 유일한 자유는 자기 자신에게만 관계되는 부분에 대해서는 절대적인 자유가 확보되어야 하나, 타인과 관계되는 부분에 대해서는 사회가 이를 규제할 수 있다고 한다. 이러한 관점에서 도핑의 행위는 타인에게 위해가 되는 행위임에 금지되어야 한다. 또한 Kant의 해결은 인간의 행위를 자유로운 행위로 만드는 조건은 행위의 의도성, 동기와 목적이 아니라 행위 자체가 지닌 도덕성이라고 하였다. Kant의 윤리학에 있어서 중심 되는 개념은 의무의 개념이다. 어떤 행위의 도덕적 가치와 도덕성은 그 행위가 산출한 결과에 있지 않고, 오로지 의무에 적합한 행위인가 아닌가에 따라서 결정된다. Kant의 의무론적 윤리관에 의하면 도핑은 언제, 어디서나, 누구에 의한 것이든 나쁜 행위이다. 왜냐하면 그것은 의무에서 행한 행위가 아니라 개인의 경향성에서 나온 것이기 때문에 도덕적으로 선하지 않다는 것이다. Kant는 오직 의무에서 행한 행위만이 도덕적으로 선 하다는 것이다. 누구나 도핑은 나쁘다고 생각한다. 그 이유는 스포츠가 지니고 있는 보편적 윤리 기준에 어긋나는 행동이기 때문이다. 이는 윤리 이론의 핵심체계인 공리주의와 의무론이 가지고 있는 보편타당한 도덕규칙에 의해 정당성을 얻을 수 있다. 또한 이들 윤리이론의 검토는 반 도핑에 대한 도덕적 사고의 규범과 윤리를 정초해야 하는 스포츠에서의 당위적 명제이다.
